Mitigation is required for partial impact to landward 50' of buffer, impacts necessary to construct a safe, compliant entrance (VDOT private entrance standards) to property located on Dudley Mountain Rd (Rte. 706). Entrance should provide off -road storage while gate is opened. Impact will extend from Rte. 706 to such point that driveway transitions to alignment that lies outside the 100' buffer as it crosses the remainder of the property. Ability to safely exit SR 706, to safely open gate and maneuver are primary objectives. Please estimate Area of proposed driveway /entrance within the stream buffer. Calculate mitigation required for this area (Attachedloptions). Disturbance within 50' of stream is not necessary. Further, no mechanism exists in this situation to allow disturbance within 50' of stream. Avoidance is possible. Alignment, improvements, and disturbance other than plantings /pasture maintenance within 50' of the stream is prohibited. Attached planting options guidance does not appear in current online Albemarle County Design Standards Manual (ACDSM), but this guidance remains reliable. Please refer to it. Engineering Review Mitigation Plan Checklist (Attached), MITIGATION ITEMS (bottom of pg) are important: planting scheme = 2 X disturbed area. EXAMPLE: Drive W =10' (Min width —see below). If 200' falls within landward 50' ft of buffer, then impact =2,000 sf. 2,000 X 2 = 4,000, guides Mitigation. Mitigation/3 options /Ea. meets requirements for a 400 SF unit (or fraction): Choose option /plantings for 10 units (4,000 sf). This might be ten (10) 1- %2" to 2" caliper trees, or 10 evergreens (4') and ten (10) small shrubs (15" — 18" ht). Choose native plants. Link to native plants: hqp: / /www.albemarle.or /ng ativeplants/ Once you estimate impact, you may reduce by 100' X 10' (1000 sf) in recognition of need for safe entrance. Please show calculations, show 1,000 sf reduction, furnish sketch that shows: alignment of proposed drive relative to Rte. 706, and 100' stream buffer. Driveway Alignment should exit buffer as soon as practicable. (please do not double reduction -1000 sf Max) There is no need to appeal ordinance requirements, unless to challenge Mitigation. You may locate a private residential entrance at existing gated field entrance, with VDOT approval. Coordinate with Dennis Seale, VDOT, who has your number, and plans to call. We discussed mitigation planting requirements in general. With attached information, once calculations are performed and options considered, you may appeal if you wish, explain special circumstance. I will relay any appeal to the County Engineer. Mitigation and Avoidance are key strategies. I visited the site, offer what I believe is possible given constraints and importance of ordinance requirements. Total mitigation plantings may number 10, or less. Plantings should be located within 100' of the stream —that is, within the stream buffer. Please indicate general location of Mitigation plantings on a sketch showing: stream; buffer; impact to buffer (report SF); and, proposed driveway. This sketch will guide Mitigation Plan approval, building permit issuance, and inspections typical of Mitigation Plans and residential construction. A Mitigation Plan bond will be required. The blue line is to the left [south] of the stream and gate. I propose the driveway to be to the right [north] of the stream in line with the existing gate. No tress or vegetation would be disturbed in placement of the drivewy to the left [north] of the stream.. please reply with the redrawn blue line. Please note that the gate is located in the break in the tree line along Dudley Mtn RD. Location of proposed driveway is shown in blue marker on the GIS image, and is partially within stream buffer. I have not visited the site, but earlier today you explained a spring gives rise to a 100 -yd stream on this parcel (TMP 89 -61A). Could you confirm that the blue line in the Google Map image, below, indicates approx location of the proposed driveway? I have tried to mirror the location on the GIS image left with the development form. Also, is the green line in the second image below also a fair approximation of the proposed driveway location? We are comparing proposed driveway location with Albemarle County Ordinance Sec. 17 -604 (excerpt): <image003.jpg> Please consider this section, and consider a slight bend in (green line) alignment that may help keep the driveway within the landward 50 horizontal feet of the stream buffer. For example, a single bend may help ensure that the driveway is fifty feet from the stream, while still ending at the home site. This could be coordinated during construction. Also, please explain if the proposed driveway will be paved, or gravel. It is helpful to know that no trees will be felled or lost to construction in the proposed location, that current land use is un- forested pasture. Please confirm if this is correct. Your notes on the stream buffer development Application make clear there is an existing pasture entrance (yellow highlight, gate), that alternative entrance locations on Dudley Mtn Rd (or Alt. driveway alignment) may require additional length, grading, and land disturbance. Minimal additional length to maintain the required minimal 50 -ft setback from the stream is, nevertheless, important. Please confirm what you can. I hope to respond to your request to develop within the 100 - stream buffer (second image) within a day or two of receiving your response.
