It is a High Hazard Dam, requiring a spillway capacity equal to the PMF (without overtopping the dam). The dam has that capacity. In addition, in reviewing the subdivision plan it appears the residential structures are out of the dam break inundation zone. Thus, the development does not alter the Hazard Class of the dam. Nor, does it require the dam owner to expand the spillway capacity of the dam. The developer has no responsibility to finance % the cost of a spillway capacity expansion. Be well, Robert J.
