To Whom It May Concern:
You have asked for a letter that provides an analysis of the zoning regarding the
referenced properties. This letter is based on a review of our zoning records.
The parcels lie within the boundaries of the County of Albemarle. As
Chief of Zoning, I have the authority to execute this letter.
■ The property is currently zoned Commercial, C-1. ZMA2005-10 was
approved May 26, 2006 to rezone TMP 61-122 to from Commercial
Office, CO to C-1. The approval letter with proffers is enclosed. A copy
of Ch. 18, Section 22 of the Zoning Ordinance outlining the permitted
uses of the district is also enclosed.
The current uses and improvements of the property include a gas
station, retail building and Wachovia bank. All of these are permitted
C-1 uses. A special use permit, SP1 999-19 was approved to allow
angled parking and one-way traffic with the condition that drive-thru
lanes are limited to five. A variance, VA -1981-68 was granted to allow
97.5 sq.ft of freestanding signage. VA -1996-14 was granted to allow a
canopy for the gas station. Property records indicate that the gas
station was built in 1960 and the original bank building was constructed
in 1973. The existing Wachovia Bank improvements were approved
under site plan SDP1999-4. The uses are either permitted and/or
legally nonconforming with respect to applicable zoning regulations in
place at that time. A demolition permit, B200700537D, is currently

under review to demolish the existing gas station and adjacent retail
building.
There is a pending site development plan, SDP2006-66 to redevelop
the site by replacing the existing gas station and retail building with an
additional 13,000 sq. ft. retail building and to modify the existing bank
on the adjoining parcel. This site plan is currently under review,
therefore all permits and approvals have not yet been obtained for new
development.
You may rely on this letter for funding a loan secured by a mortgage
lien on the Property.
