RE: ZMA 2007 -00007 McCauley Crossing
On November 25, 2013, the applicant requested indefinite deferral of this project. Since that
time, no preapplication meeting was requested, no resubmittal was made (deadline Sept. 2,
2014), no request for a public hearing was made (deadline Oct. 13, 2014), and no action has been
taken by the applicant. Therefore, this project is deemed withdrawn.

RE: ZMA 2007 -00007 McCauley Crossing
Dear Mr. Murray:
I am in receipt of your November 25, 2013 e -mail requesting indefinite deferral of the above
referenced ZMA. Section 33.4 r.2. of the Albemarle County Zoning Ordinance says:
An application shall be deemed to have been voluntarily withdrawn if the applicant requested that
further processing or formal action on the application be indefinitely deferred and the commission or
the board of supervisors is not requested by the applicant to take action on the application within one
(1) year after the date the deferral was requested. Upon written request received by the director of
planning before the one (1) year period expires, the director may grant one extension of the deferral
period for a period determined to be reasonable, taking into consideration the size or nature of the
proposed use, the complexity of the review, and the laws in effect at the time the request for extension
is made. Upon written request received by the clerk of the board of supervisors before the extension
of the deferral period granted by the director expires, the board of supervisors may grant one
additional extension of the deferral period determined to be reasonable, taking into consideration the
size or nature of the proposed use, the complexity of the review, and the laws in effect at the time the
request for extension is made. The timely receipt by the clerk of the extension request shall toll the
expiration of the extended deferral period until the board acts on the request.
Please be aware that, under these ordinance provisions, the application will be deemed
withdrawn unless: 1) the Board of Supervisors takes action on this ZMA by November 25, 2014,
or 2) a written request for extension of the deferral period is made to the Director of Planning by
November 25, 2014. This extension is at the discretion of the Director and not guaranteed. If
extension is requested and granted, the Board of Supervisors is authorized to grant one additional
extension if requested in writing before the first extension expires. This extension is at the
3iscretion of the B� of- Supervisors and not guarffteed.
Please be advised that in order to have a public hearing advertised for November 12, 2014, the
last scheduled Board of Supervisors meeting before November 25th, final material legally
acceptable for Board of Supervisors' approval must be submitted by October 13, 2014.
However, as this material constitutes proffers and an application plan, it is highly recommended
that you first re- submit your proposals for staff review and comment before submitting the final
material. At the latest, this re- submittal should be made on September 2, 2014 which allows for
staff comments back to you on October 1, 2014, 12 days before the final submittal needs to be
made. It is also highly recommended that you schedule a pre- application meeting with staff
before making a re- submittal. Pre - application meetings are held every Monday afternoon except
on holidays.
