Tax Map and Parcel Number 07800-00-00-07600 (the "Property") Dear Ms. Maleski; In response to your request concerning the above referenced property's compliance with applicable codes, regulations and ordinances, please be advised as follows: The property is zoned Planned Development -Mixed Commercial (PD -MC) under the zoning ordinance of the County of Albemarle. The PD -MC district permits those uses as allowed by Commercial, Commercial Office and Highway Commercial Zoning Districts including food stores, automobile service stations and eating establishments by right. Sections 22.2, 24.2 and 25A.2 are attached. The property is located in the Entrance Corridor Overlay District (EC) and is subject to the rules and regulations regarding this district. The building identified as Pantops Convenience Center on SDP 2001-08 was constructed in 2001. The site was found to be in compliance at the time of completion and subsequently received a Certificate of Occupancy. A copy of the CO is not available as these records are purged and are only available on microfilm. ■ The structure was built according to an approved site plan based on the current zoning ordinance and received a Certificate of Occupancy upon its completion therefore it is considered a legally conforming use and structure. Commercial development within the County is not subject to density regulations. The approved site plan allows for the development of 9270 sq.ft. of food/convenience store, restaurant, automobile services station, and office uses served by 72 parking spaces, provided as follows: 13 spaces/1000 sq.ft for food service/eating establishment, (47 spaces required), 1 space/200 sq.ft. for food store (13 spaces required), 1 space/200 sq.ft of net floor area for office space (11 spaces required). Section 4.12.6 is attached. A special use permit, SP2000-47 was approved to allow a drive-thru window for the restaurant. The approval letter with conditions is attached. ■ This office has no record of current zoning or site plan violations. A site compliance visit on September 4, 2007 showed no deviations or possible violations. ■ There are no pending zoning or development applications for the property.
