In response to a request for a Letter of Zoning Compliance for the above referenced
parcel, please be advised of the following:
■ The parcel lies within the boundaries of Albemarle County and as the
Manager of Zoning Administration for the County I am authorized to execute
this letter.
■ The parcel is zoned Planned Unit Development and is located in the Entrance
Corridor Overlay District (EC) and within the Airport Impact Area. Sections
20.4.1 and 22.2.1 allow eating establishments by -right. Sections 20.4 and
22.2.1 are attached.
■ The parcel is developed in accordance with an approved site plan, SDP1995-
16 as a restaurant, served by 89 parking spaces which complies with the
current parking regulations as set forth in Sec. 4.12.6.
■ The property received a variance in 1995, VA1995-08, which allowed the 20
foot tall free-standing sign to exceed the maximum sign height of 12 feet. A
copy of the approval letter with conditions is attached.
■ This office has no record of any outstanding violations for the parcel. A site
inspection conducted on November 30, 2007 showed no deficiencies or
deviations from the approved site plan.

■ While our records show the property as TMP 061 ZO-03-00-011 BO, this is not
an official determination of the parcel of record. If you desire such a
determination, you will need to submit an application with the fee and proper
documentation as called for in the application (attached).
■ This office does not regulate the subdivision ordinance, therefore we cannot
confirm compliance. Please contact John Shepherd, Chief of Current
Development to obtain this information.
The restaurant was constructed in 1995. A Certificate of Occupancy is not
available for this building. The absence of a certificate of occupancy for the
Project will not give rise to any enforcement action affecting the Project. A
certificate of occupancy for the Project will only be required to the extent of
any construction activity (such as restoring, renovating or expanding the
Project or any part thereof).
■ The current use and improvements for the above parcel are in compliance
with all applicable zoning codes, rules and regulations of the zoning district.
