In response to a request for a Letter of Zoning Compliance for the above referenced
parcel, please be advised of the following:
■ The parcel lies within the boundaries of Albemarle County and as the
Manager of Zoning Administration for the County I am authorized to execute
this letter.
■ The parcel is zoned Planned Development -Mixed Commercial (PD -MC) and
is located in the Entrance Corridor Overlay District (EC). Section 25A.2.1 and
24.2.1.30 allow eating establishments as a by -right use. These sections are
attached.
■ A zoning map amendment, ZMA 1998-20, allowed the parcel to be rezoned
to PD -MC. The rezoning was approved October 26, 1998 with proffers. A
copy of the approval letter with the approved proffers is attached.
■ The parcel is developed in accordance with an approved site plan. Phase I of
SDP2003-52 is developed as a 4,850 sq.ft. restaurant and is served by 79
parking spaces which meets the current parking regulations as set forth in
Sec. 4.12.6.

This office has no record of any outstanding violations for the parcel. A site
inspection conducted on November 28, 2007 showed no deficiencies or
deviations from the approved site plan.
■ The current use and improvements are in compliance with all applicable rules
and regulations of the zoning ordinance.
A Certificate of Occupancy was issued July 1, 2005. It is the policy of this
department to purge building permit files after three years. Copies of
Certificates of Occupancy are maintained on microfilm. Therefore, we have
not retained any copies of Certificates of Occupancy associated with this
project. Furthermore, the absence of a Certificate of Occupancy for the
project will not give rise to any enforcement action. Please be aware that
interior renovation that does not involve a change of use does not require a
Certificate of Occupancy. You may obtain a copy of a Certificate of
Occupancy for an additional fee of $25.00 each.
■ While our records show the property as TMP 07800-00-00-073A2, this is not
an official determination of the parcel of record. If you desire such a
determination, you will need to submit an application with the fee and proper
documentation as called for in the application (attached).
■ This office does not regulate the subdivision ordinance, therefore we cannot
confirm compliance. Please contact John Shepherd, Chief of Current
Development to obtain this information.
■ This office is not aware of any plans or proposed changes to Route 250 or to
any adjacent properties that could impact the property.
