Dear Ladies and Gentlemen:
In response to your request for a letter of zoning compliance for the above
referenced Property, please be advised of the following:
The Property is zoned Planned Development Mixed Commercial (PD -MC)
and is subject to the special conditions and proffers set forth in zoning
case ZMA1992-012. It is also within an Entrance Corridor (EC) Overlay
District. Copies of the Zoning Ordinance sections dealing with PD -MC
districts as well as the proffers are attached.
■ The use of the Property for a 70,022 square foot three-story office building
with appurtenant parking facilities is a use permitted as a matter of right
under the PD -MC district and no special use permit or variance is
required.
■ The final site development plan (SDP -2005-133) for the Property, was
approved on May 27, 2006.
■ If constructed in accordance with the approved site development plan the
Property will be in compliance the Zoning Ordinance of Albemarle County,
including, but not limited to, all provisions regulating setbacks, density,
parking-and-heigh#.
The Property is recognized as a separate parcel of land and may be
conveyed, leased, or mortgaged as a separate parcel. The Property has
been legally subdivided and is in compliance with the current subdivision
ordinance of Albemarle County. The Property is not subject to any other
conditions or special limitations imposed by the County of Albemarle in
connection with any subdivision approval of the Property.
■ There is no record of any outstanding zoning violations with respect to the
Property.
