Dear Mr. Foust:
This certification regarding the zoning status of the above -referenced Property
is provided to American Equity Investment Life Insurance Company at the request of
the above -referenced owner.
(a) The zoning code affecting the Property is the Zoning Ordinance of the
County of Albemarle, Virginia. The Property is in the Highway Commercial
(HC) District of the County, which permits various uses, including shopping
centers, eating establishments, administrative/business/professional
offices, and laundries as by -right uses.
(b) The Property was developed according to an approved site plan.
SDP1989-43 entitled Townside East, last revised on May 17, 1989. The
site is developed as a 35,200 sq.ft. shopping center served by 157 parking
spaces. The business currently occupying the shopping center use 157
parking spaces.
(c) The shopping center was built according to property records in 1990.
Certificate of Occupancy data for the original building is not available.
(d) A special use permit, SP -1992-34, was approved with conditions to allow a
drive -up kiosk for a pharmacy. The approval with conditions is attached.

(e) The Property is the subject of several variances:
a. VA -1987-38 was approved with conditions to allow a reduction in
parking setbacks.
b. VA -1987-83 was approved to allow a reduction in parking setbacks
and structure setback from the Scenic Areas -Highway Overlay
District.
c. VA -1988-52 was approved to allow a reduction in the structure
setback from the Scenic Areas Highway Overlay District and to
abandon previously approved variances with exception to the
parking setback variance.
d. VA -1990-58 was approved with conditions to allow variations to the
signage, setbacks, number of signs, and the square footage allowed
for signage.
e. VA -1990-82 was denied.
(f) The Property is a conforming use under the Zoning Ordinance of the
County of Albemarle, Virginia. A site inspection conducted on February
27, 2008 showed no deficiencies or deviations from the site plan, and no
potential violations.
(g) This office does not regulate the subdivision ordinance, therefore we
cannot confirm compliance. Please contact Bill Fritz, Chief of Current
Development to obtain this information.
