Trade Street Suite 400 Charlotte, NC 28202 RE: Tax Map 61, Parcel 134, BB&T Bank 1425 Seminole Trail, Charlottesville, VA To Whom It May Concern: In response to your request for a Letter of Zoning Compliance, please be advised of the following: • The above referenced parcel is zoned Commercial Office (CO) and is located in the Entrance Corridor (EC) Overlay District. The parcel is not part of a Planned Unit Development, • The property is developed as a financial institution which is operating as BB&T Bank, Financial institutions are a by -right permitted use in the HC district. Drive-thru facilities are allowed by Special Use Permit, however, there is no subject SID to allow the drive thru facilities. This building predates the current zoning ordinance, therefore, the existing drive thru's are a legally non- conforming use. • There was a special use permit, SP1977-52, and an accompanying zoning text amendment (ZTA1 977-07) to allow a helistop on the property. The heliport was never constructed and the SP has since expired. • The latest site development plan, SDP2003-42, shows a four story bank with office space and allows a 20,230 square foot building served by 92 parking spaces. • The parcel is bordered by property zoned Planned Development Shopping Center (PD -SC) along the north and partially northeast; by property zoned Planned Unit Development (PUD) along the south and southeast. The parcels across Route 29 (Seminole Trail) are zoned Commercial and PD -SC. A zoning map of adjacent parcels is attached. Grandbridge Real Estate Captial May 22, 2008 Page 2 • A site inspection was conducted on May 21, 2008 at which time the zoning inspector identified a clumpster located in the front parking area. This is not an approved location for a dumpster. Therefore it is in violation of the site plan and zoning ordinance. A Notice of Violation will be issued. • This office has no record of additional open violations for this parcel. • Property records indicate that this building was constructed in 1979. It is the policy of this department to purge building permit files after three years. Copies of Certificates of Occupancy are maintained on microfilm. Therefore, we have not retained any copies of Certificates of Occupancy associated with this project. Furthermore, the absence of a Certificate of Occupancy for the project will not give rise to any enforcement action. Please be aware that interior renovation that does not involve a change of use does not require a Certificate of Occupancy. You may obtain a copy of a Certificate of Occupancy for an additional fee of $25.00 each. Please contact me if you have questions or require additional information.
