Special use permits for uses as provided in this ordinance may be issued upon a finding by the board of supervisors that such use will not be of substantial detriment to adjacent property, that the character of the district will not be changed thereby and that such use will be in harmony with the purpose and intent of this ordinance, with the uses permitted by right in the district, with additional regulations provided in section 5.0 of this ordinance, and with the public health, safety and general welfare." How will the proposed special use affect adjacent property? Hillsdale drive is designated by TJPDC as a "parallel" road to US29 and is becoming subjected to increasing volumes of traffic, as congestion on US 29 increases. An "adjacent" property to Church of the Incarnation, is Fashion Square Mall that has a single entrance/exit on Hillsdale Drive, very close to the Church of the Incarnation's northern entrance. Traffic attempting to enter/exit from the Mall, from Hillsdale Drive, already poses a traffic hazard. At 12 noon on Sunday, the Mall opens its doors to the buying public, at exactly the same time as parishioners attending the 11 am Mass are attempting to leave Church of the Incarnation, just a short distance away, creating a major interruption of the traffic flow on Hillsdale Drive. Encouraging Church of the Incarnation visitors to enter and exit the property from the southern entrance (some distance from the Mall entrance) will provide a huge benefit to Fashion Square Mall. How will the proposed special use affect the character of the district(s) surrounding the property? The proposed special use should serve only to enhance the character of the surrounding district. The sign is tastefully designed and compliments the architecture of both the church and other nearby buildings. How is the use in harmony with the purpose and intent of the Zoning Ordinance? Section 20.1 of the Albemarle County Code states that, "PUD districts are intended to serve as neighborhoods or mini -neighborhoods within designated communities and the urban area. Church of the Incarnation states that their function in the community is to, "provide spiritual, emotional, and financial support for those in need within the parish and in the broader community... The Church of the Incarnation will be a parish community that is inclusive, welcoming, and hospitable; characterized by, but not limited to, diversity of culture, ethnicity, and generation." (www.incamationparish.org). The proposed special use would alert members of the community traveling north on Hillsdale Drive of the church's location. How is the use in harmony with the uses permitted by right in the district? The specific use of the property as a church is allowed by Section 20.3.2.6. What additional regulations provided in Section 5.0 of the Zoning Ordinance apply to this use? Section 20.3.1 #5 "Parks, playgrounds, community centers and noncommercial recreational and cultural facilities such as tennis courts, swimming pools, game rooms, libraries and the like." Section 20.3.2 #1 "Day care, child care or nursery facility (reference 5.1.06)." Section 20.3.2. #6 "Churches. (Added 9-2-81)." How will this use promote the public health, safety, and general welfare of the community? As stated above, we believe that the proposed special use will alert members of the community, traveling north on Hillsdale Drive, to the church's location. Attached are pictures illustrating the topography of the two parcels in question. You will notice a gradual bend in the road beginning at the southern entrance of the Church of the Incarnation. It is our position that this bend prevents travelers from seeing the northern entrance to the church and therefore poses a potential traffic hazard. By the time the sign at the northern entrance becomes visible to commuters traveling north (75' from entrance), they will not have adequate time to decelerate and navigate the turn. The VDOT driver's manual suggests that motorists should indicate when they are preparing to turn, 200' before the turn. Also, Church of the Incarnation is a busy parish with a very large congregation of well over 1,000 families. There are three Sunday Masses and having that number of congregants trying to enter and exit the property at one intersection at Hillsdale drive causes a huge bottleneck. It is vital to public safety that as many people as possible are made aware of the second entrance (and exit). Describe your request in detail and include all pertinent information such as the number of the persons involved in the use, operating hours, and any unique features of the use: Church of the Incarnation would like to request that the Board of Zoning Appeals consider an application allowing them to install an 11 square foot sign, mounted between two 4" x 4" post, on to parcel 061Z0-03-00-00900. The church is open from 8:30am — 2:00pm on Mondays, 8:30am — 4:30pm Tuesday — Friday and during Mass on weekends.
