STAFF CONTACT: Megan Yaniglos, Senior Planner PLANNING COMMISSION: November 11, 2008 AGENDA TITLE: SDP 01 -113 Precision Sports Surfaces, Inc., Phases I and II — Final Site Plan Extension PROPERTY OWNER: Sea Grove, LLC APPLICANT: R. Anderson Hord, III - Precision Sports Surfaces, Inc. APPLICANT'S PROPOSAL: Applicant is requesting extension of final site plan approval, in accordance with Section 32.4.3.8 of the Zoning Ordinance. The applicant received approval of an extension of the final site plan on June 27, 2006 for a period of 24 months. The applicant is now requesting an additional 24 -month extension since the previous approval will expire January 4, 2009(Attachment B). Final site plan approval was granted January 4, 2002 for the construction of a new 7,200 square foot building (Phase I) and a new 4,800 square foot building (Phase II) to replace an existing building on site (Attachment Q. The project is intended for expansion and upgrades to an existing use on the site. The site is zoned Light Industry, LI, and is described as Tax Map 58, Parcel 37G. The property is located in the Samuel Miller Magisterial District at the intersection of Dettor Road (private) and Lobban Place (private), approximately 1000 feet from Route 250 East. COMPREHENSIVE PLAN: The Comprehensive Plan designates this property as Rural Areas in Rural Area 3. PLANNING AND ZONING HISTORY: • SDP 2001 -092 Precision Sports Surfaces, Inc. — The preliminary site plan for this site was approved October 11, 2001, with conditions. • SDP 2001 -113 Precision Sports Surfaces, Inc. — As mentioned previously, the final site plan was approved January 4, 2002. • SDP 2002 -014 Precision Sports Surfaces, Inc. — A minor site plan amendment for the site was approved March 8, 2002, which shifted the location of one of the buildings by approximately 4 feet. Other relevant history: The existing access to TMP 58 -37G is Lobban Place, which was created as a 40 -foot joint access right -of -way in 1978 as part of a subdivision of the lot (SUB 1978 -094 — Tull). At that time, it went before the Planning Commission, and was approved as a 16 -foot wide gravel road with a minimum 6 -inch base of stone. The first building on the adjacent site (TMP 58, Parcel 37C1) was an office warehouse for Bearing Technology Inc., which used Lobban Place as its primary access (SDP 1978 -061). Subsequently, a preliminary site plan was reviewed to add a second building to the site for Ivy Warehouse (SDP 1998 -090 and amendments). Based on additional usage of the road, upgrades were recommended, and Lobban Place was expanded to 18 feet wide, with other improvements to the road. The use of the site has not changed since then. The road is still considered to be adequate to serve both properties. REASON FOR PLANNING COMMISSION REVIEW: The Planning Commission must approve requests for extension of site plan approval, as specified below: Section 32.4.3.8 a. An approved final site plan shall be valid for a period of not less than five (S) years after the date of K approval thereof or for such longer period as the commission or the agent may, at time of approval, determine to be reasonable, taking into consideration the size and phasing of the proposed development. A site plan shall be deemed to be final once it has been signed by the agent and if the only requirement remaining to be satisfied in order to obtain a building permit is the posting of any bonds and escrows. b. Upon application of the developer submitted prior to expiration of the final site plan, the commission may grant one or more extensions of such approval for periods as the commission may, at time the extension is granted, determine to be reasonable, taking into consideration the size and phasing of the proposed development, and the laws, ordinances, and regulations in effect at the time of request for an extension. REVIEW OF REQUEST FOR EXTENSION OF FINAL SITE PLAN APPROVAL: Staff has reviewed the request in accordance with Section 32.4.3.8 (b), to determine whether the site plan would still be in compliance with the "laws, ordinances, and regulations" in effect today, and thus be approvable otherwise. The uses proposed for both buildings include "contractor's office and equipment storage yard" and "warehouse facilities ". Each of these uses is still an allowable use in the LI, Light Industry zoning classification. As presented in the "Planning and Zoning History" section, the access is also still acceptable. There have been more than 30 Zoning Text Amendments approved since this site plan was approved. This site plan complies with these changes to the Zoning Ordinance. Section 32.4.3.8 (b) also speaks to taking into consideration the size and phasing of the proposed development. The size of the proposed development is a total of almost 12,000 square feet, in two phases. The larger of the two phases is Phase I, which has not been constructed yet. As the owner explains in the request letter, the reasoning for the request is that their existing structures satisfy their immediate needs. RECOMMENDATION: Based on the analysis of changes to local and State Ordinances, staff concludes that this site plan would be approved today if it was submitted as a new plan. Thus, Staff recommends approval of the extension of final site plan approval for the two (2) years requested by the applicant. If approved by the Planning Commission, the plan will be valid until January 4, 2011.
