Dear Ms. Dawson:
This letter replaces my letter to you dated April 20, 2004.
You have asked for a letter that provides an analysis of the zoning and other information
regarding the referenced property, located at 1646 Seminole Trail in Charlottesville, VA. This
letter is based on a review of our records and an inspection of the site.
1. The property is zoned HC, Highway Commercial. The property is located in the Airport
Impact Area Overlay District -AIA and in the Entrance Corridor Overlay District -EC.
2. The HC zoning allows certain retail sales and services on the site as a matter of right. The
Mattress Warehouse, E.B. Games and New Balance / Birkenstock are retail sales uses.
3. This development, including the parking is a legal conforming site built in accord with a site
development plan, SDP -2002-10 that was approved on June 11, 2002 and amended on
September 12, 2003. The portion of the building used for mattress sales, 4,500 square feet
requires 9 parking spaces. The portion of the building used for retail sales, 4,620 square feet,
requires 36 spaces. There are 45 parking spaces on the site. A copy of the site plan is
enclosed.
There are no nonconforming primary or accessory uses associated with the Bojangles
restaurant that was formerly located on this site.
4. A review of our records does not show any Variances, Special Permits or other conditions
that apply to the subject property.

5. In the event of casualty to the project, in whole or in part, the project will be permitted to
rebuild in accord with the approved site plan. If the ordinance is changed in the future, the
site could be rebuilt as provided in Section 6, Nonconformities.
6. There are no unresolved zoning or building code violations identified on this site at this time.
7. The site was most recently inspected for zoning compliance on March 23, 2004. On that date,
with the exception of the items identified in #6, the site was found to be in compliance with
the approved site plan.
8. Temporary Certificates of Occupancy (TCO) were issued on January 14, 2004 for the space
occupied by E.B. Games, on February 3, 2004 for the space occupied by Mattress Warehouse
and on March 10, 2004 for the space occupied by New Balance / Birkenstock. Copies of
these TCOs are enclosed. Certificates of Occupancy will be issued when the items that are
identified on the TCOs are resolved.
9. A zoning clearance was issued to E.B. Games for retail sales on this site on January 12, 2004.
On January 29, 2004 clearances were issued to Mattress Warehouse and to New Balance /
Birkenstock for retail sales. Copies of these clearances are enclosed.
