Fox, Jr. Foxfyre Enterprises, Inc. 4543 Garth Road Charlottesville, VA 22901 RE: SP -2002-50 Shadwell Animal Hospital Tax Map 79, Parcel 19 Dear Mr. Fox: This is a response to your questions regarding Special Permit 2002-50. 1 am also enclosing a copy of a letter to Jane Covington, dated June 24, 2004 that addresses additional issues on this site. The Board of Supervisors approved the special permit for the Shadwell Animal Hospital on January 15, 2003. The approval is subject to the following condition: "An amended site plan showing the change of use shall be submitted for approval." The permit will expire on January 15, 2005 if the use is not commenced by that date. A copy of the approval letter is enclosed. I have summarized your questions as follows: 1. Can the animal hospital occupy up to 4,000 square feet and be located in a portion of the existing 14,000 square foot building rather than in the smaller 2,112 square foot building? The approval of the special permit did not limit the area of the animal hospital. Therefore, the use could occupy additional area within the buildings shown on the site plan. 2. What is required to construct a 750 square foot per floor, two-story addition to the tea shop? While the Board of Supervisors did not limit the size of the animal hospital, the review and approval of the special permit was based on the amended Clifford Fox June 25, 2004 Page 2 Shadwell Antiquaries site plan that was dated March 20, 2000. The proposed addition to the tea shop for the expansion of the animal hospital will require an amendment to the special permit. This will also require an amendment of the site plan and a building permit. 3. Will VDOT or the County require any financial contribution for the proposed intersection improvements at the U.S. 250 and Route 22 intersection? Improvements to Route 22 may be a condition of approval of the amended site development plan that is required as a condition of approval of SP - 2002 -50. This issue was discussed by the Planning Commission and the Board of Supervisors during the review of SP -2002-50. Copies of the Commission's December 10, 2002 minutes and the Board's January 15, 2003 minutes are enclosed. Please contact me if you have questions.
