College, TW -16 Mail Code NC0166 Charlotte, NC 28288-0166 RE: Peter Jefferson Place V 590 Peter Jefferson Parkway Charlottesville, VA 22911 Tax Map 78, Parcel 3 1 H Dear Wachovia Securities: In response to your letter of June 8, 2004, requesting a zoning compliance certificate for the captioned property, please be advised of the following. This letter is based on a review of our records and an inspection of the site. 1. The property is zoned PD -MC, Planned Development -Mixed Commercial, and is proffered per ZMA-96-03. The property is also in the EC, Entrance Corridor Overlay District. Section 25A of the Zoning Ordinance, proffers and a modification letter dated June 2, 2003 are enclosed. 2. The use of the property for a 76,300 square foot office building with appurtenant parking facilities consisting of 300 spaces is a use permitted as a matter of right under the PD -MC district and no special permit or variance is required. Uses that are permitted by right in the C-1, CO and HC districts are permitted by right in the PD -MC district. Please be aware that 300 parking spaces are required for this site based on 1 space per 200 square feet of net floor area assuming an office or medical office use. Dental clinics require 1 space per 175 square feet of net floor area. A site development plan, SDP -2000-152, was approved for the captioned parcel on February 13, 2001. That plan has been amended with two letters of revision, one dated May 6, 2003 and the other March 25, 2004. Copies of these letters are enclosed. 3. The property is developed in accord with the approved site development plan referenced above and is in compliance with the Zoning Ordinance of Albemarle C:\inetpub\wwwroot\cityviewlazerfiche_integration\tempdocholder\5268.doc Wachovia Securities July 6, 2004 Page 2 County, including but not limited to, all provisions regulating setbacks, density, parking and height. 4. The 7.447 -acre property is recognized as a separate parcel of land and may be conveyed, leased, or mortgaged as a separate parcel. The property has been legally subdivided, as evidenced by a plat by Jordan Consulting Engineers, P.C. that is dated January 2, 2001 and was approved by the County on January 4, 2001. The property is in compliance with the current subdivision ordinance of Albemarle County. The property is not subject to any other conditions or special limitations imposed by the County of Albemarle in connection with any subdivision approval of the Property. 5. This department has no record of any past or pending zoning violations or Building Code violations with respect to the property apart from the matter mentioned in #7. 6. Copies of three temporary certificates of occupancy for this building are enclosed. 7. The site was inspected for zoning compliance on March 16, 2004. The storage of construction materials that are associated with the adjacent parcel and are stored in 12 parking spaces on the site constitutes a violation of the site plan. 8.
