APPLICANT'S PROPOSAL:
Request for final subdivision plat approval [Attachment C] to create 2 lots on 2.428 acres.
PLANNING AND ZONING HISTORY:
SUB2007 -164- Boundary line adjustment for tax maps 76C -02 parcel 1, 76C -02 parcel 4, and 76C -02 parcel 5
that was approved in June 2007 and recorded.
SUB2007 -392- Preliminary plat approved with conditions on February 19, 2008 [Attachment B].
COMPREHENSIVE PLAN:
The Comprehensive Plan designates this property as Neighborhood Density in Urban Area 6.
REASON FOR PLANNING COMMISSION REVIEW:
In order to met a condition of approval for the preliminary plat [Attachment D].
DISCUSSION:
The proposed subdivision is in the development area [Attachment C] and is subject to the review requirements
contained in Section 14 -206 (A) of the Subdivision Ordinance. The plat has been reviewed by the site review
committee and has been found to meet all of the requirements of this section of the ordinance.
When the preliminary plat was approved in February 2008, the Planning Commission approved the plat with a
number of conditions [Attachment D] that are listed below followed by a description of how the condition was
met.
1. The final plat shall be subject to all applicable requirements of the Zoning, Water Protection,
and Subdivision ordinances.
The final plat has been reviewed and meets all the requirements of the Zoning, Water Protection,
and Subdivision ordinances.
2. The final plat shall not be approved until written approval has been received from the Health
Director. The findings of the Health Director shall take into consideration all water features
located on the property as identified by the Natural Resource Manager who shall coordinate
with the DEQ and the US Army Corps of Engineers.
The final plat has been reviewed and approved by the Health Director [Attachment G]. The
health department reviewed the plat based upon all the water features that were located on the

property. The Natural Resources Manager has left the County since the approval of the
preliminary plat, and because of budget constraints, the position was frozen and not filled.
Another Staff member, the intern for the Groundwater Manager and Water Resources Manager,
field verified the water features that were located on the property. Prior to leaving the County, the
Natural Resource Manager coordinated the review of this project with representatives from DEQ
and Army Corps of Engineers. The DEQ and the Army Corps of Engineers have given approval
of the subdivision [Attachments E and F].
3. The Natural Resource Manager shall field verify the location of all water features on the
property.
As stated above, the Natural Resources Manager has left the County since the approval of the
preliminary plat, and because of budget constraints, the position was frozen and not filled.
Another Staff member, the intern for the Groundwater Manager and Water Resources Manager,
field verified the water features that were located on the property. The intern field verified the
location of all the water features on the property as shown on the current subdivision plat
[Attachment C].
4. The final Plat shall be reviewed by the Planning Commission.
The final plat is currently being reviewed by the Planning Commission.
5. Field run topography, location of primary and secondary drainfields, critical slopes, spring
houses, streams and other water features shall be shown on the final plat.
All required information including the field run topography, location of primary and secondary
drainfields, critical slopes, spring houses, streams and other water features are shown on the final
plat [Attachment C].
RECOMMENDATION: Staff finds that the proposed subdivision meets the requirements of the zoning, water
protection, and subdivision ordinances, as well as has met all the conditions of preliminary approval. Staff
recommends approval.

The Department of Environmental Quality (DEQ) received your application on
September 24, 2008 for the referenced project. Based on the information provided in the JPA, it
does not appear that a Virginia Water Protection (VWP) permit will be required because the
project as presented qualifies for a U.S. Army Corps of Engineers Regional, General or
Nationwide Permit for which DEQ has provided §401 Water Quality Certification.
If the above - listed exclusion describes your project, it will not need a VWP permit but
may require review or approval under other federal, State, or local programs. Should the size
and scope of the project change, a VWP permit may be required. If you have any questions,

This is regarding your request to perform work in the waters of the United States, as described in part 4 above. This activity has
been reviewed and found to satisfy the criteria contained in the Corps Nationwide Permit (18), attached. These impacts are detailed
on the enclosed drawings, "Wetland Delineation flap" and "Preliminary Subdivision Plat for Tax Map 76C. Section 2, Parcel l."
Your proposed work as outlined above satisfies the criteria contained in the Corps \ationwide Permit (18), attached. The Cotes
Nationwide Permits were published in the March 12, 2007, Federal Register notice (72 FR 47) and the regulations goveming their use
can be found in 33 CFR 330 published in Volume 56, Number 226 of the Federal Register dated November 22. 1991.
Provided the Nationwide Permit General Conditions (enclosed) are met. an individual Department of the Army Permit will not be
required. In addition, the Virginia Department of Environmental Quality has provided >401 Water Quality Certification for
Nationwide Permit Number (18). 1Iowever, a permit may be required from the Virginia Marine Resources Commission and/or your
local wetlands board, and this verification is not valid until you obtain their approval, if necessary. This authorization does not
relieve your responsibility to comply with local requirements pursuant to the Chesapeake Bay Preservation Act (CBPA). nor does it
supersede local government authority and responsibilities pursuant to the Act. You should contact your local government before you
begin work to Find out how the CBPA applies to your project.
Enclosed is a "compliance certification" form, which must be signed and returned within 30 days of completion of the project,
including any required mitigation. Your signature on this form certifies that you have completed the work in accordance with the
nationwide permit terms and conditions.
This NWP verification is valid for two years from the date of this letter. If this verification letter expires before the NWP itself
expires, the activity continues to be authorized until the expiration date of the NWP, and it is not necessary to obtain a new
verification. Project specific conditions listed in this letter continue to remain in effect after the NWP verification expires, unless the
district engineer removes those conditions. All of the existing NWPs are scheduled to be modified, reissued, or revoked prior to
March 18, 2012. We will issue a special public notice announcing any changes to the nationwide permits when they occur; however,
it is incumbent upon you to remain informed of changes to the NWPs. Pursuant to 33 CFR 330.6(b), activities which have
commenced (i.c, arc under construction) or are under contract to commence in reliance upon an NWP will remain authorized
provided the activity is completed within twelve months of the date of an NWP's expiration, modification, or revocation, unless
discretionary authority has been exercised on a case -by -case basis to modify, suspend, or revoke the authorization in accordance with
33 CFR 330.4(e) and 33 CFR 330.5 (c) or (d). Activities completed under the authorization of an NWP which was in effect at the
time the activity was completed continue to be authorized by that NWP.

RE: Review of Proposed Subdivision Plat for Individual Onsite Sewage Systems,
Tax Map Parcel: 76C -02 -1, Albemarle County
On September 12, 2007 the County of Albemarle . requested the Charlottesville - Albemarle Health
Department to review the proposed subdivision plat identified above. The request for subdivision
review was submitted pursuant to the provisions of § 32.1 -163.5 of the Code of Virginia, which
requires the Health Department to accept private soil evaluations and designs from an Authorized
Onsite Soil Evaluator (AOSE) or a Professional Engineer working in consultation with an AOSE
for residential development. This subdivision was certified as being in compliance with the Board
of Health's regulations by Michael Craun, PE, License #036859. Based on our review, the plat
was found to be in compliance with state and local regulations and was approved on November
15, 2007.
On April 12, 2008, the County asked us to review proposed changes to the plat and the treatment
system. At that time, William J. Loth, IV, AOSE #237, certified the soils report submitted by
Michael Craun, PE. These changes were found to be in compliance with the regulations and were
approved on April 22, 2008.
On October 22, 2008, you sent us updated information on water features located on the property
and asked us for final review. This information included: (1) a project description from the U.S.
Army Corps of Engineers dated October 3, 2008; (2) a revised -plat dated October 7, 2008; and
(3) a copy of correspondence from the Department of Community Development to Mr. Bonner
dated February 26, 2008, outlining conditions needed before final approval. On November 10,
2008, Jeff McDaniel, Health Department Environmental Health Manager, contacted Mr. Josh
Rubinstein, Albemarle County Acting Natural Resource Manager, to discuss any concerns about
the plat. No concerns other than what was already noted in the paperwork were cited. On
November 12, 2008, Mr. McDaniel, Environmental Health Manager, and I completed a site visit to
review the proposal.
This letter is to inform you that the above referenced subdivision plat with revisions is approved
for individual onsite sewage systems in accordance with the provisions of the Code of Virginia,
the Sewage Handling and Disposal Regulations (12 VAC 5- 610 -10 et seq., the "Regulations "),
and local ordinances. This subdivision approval is issued in reliance upon certification from Mr.
Craun and Mr. Loth.

Pursuant to § 360 of the Regulations this approval is not an assurance that Sewage Disposal
System Construction Permits will be issued for any lot in the subdivision identified above unless
that lot is specifically identified on the above referenced plat as having an approved site for an
onsite sewage disposal system, and unless all conditions and circumstances are present at the
time of application for a permit as are present at the time of this approval. This subdivision may
contain lots that do not have approved sites for onsite sewage systems. This subdivision
approval is issued in reliance upon the certification that approved lots are suitable for "traditional
systems;" however, actual system designs may be different at the time construction permits are
issued. This subdivision approval does conform with the requirements of local ordinances.
