Dear Mr. Wilke:
This is letter is to remind you that your application has been incomplete since July 18,
2008. At your request, on August 1, 2008, 1 e-mailed you a list of the issues that
require resolution in order for the County to process your application. Below is a list of
the issues that are still outstanding:
1. County records still show that tax map 77, parcel 32A is owned by the Thomas
Jefferson Memorial Foundation. Your application listed the owner as S.E.
Cemeteries of Virginia, Inc. Please provide owner information.
2. In your application, you included tax map 77, parcel 35A. This parcel is inactive.
This parcel was combined with parcel 35. Please remove this parcel from your
application.
3. Tax map, 77, parcel 33 was not included in your amendment. Parcel 33 was
part of SP200600015. Should this parcel be included in the amendment? The
owner of this parcel is Monticello Memory Gardens, Inc.
4. Ownership information - Based on the information you provided, it appears that .
S.E. Cemeteries of Virginia, Inc., is a subsidiary.of Monticello Memory Gardens,
Inc. Please provide the corporate documents for S.E. Cemeteries. of Virginia,
Inc. and a list of the officers authorized to sign legal documents on behalf of the
corporation. The application was signed by Mr. Jack Yent, President of S.E.
Cemeteries of Virginia, Inc.

Section 31.2.4.1 of the Albemarle County Zoning Ordinance states that, "The board of supervisors hereby

uses as provided in this ordinance may be issued upon a finding by the board of supervisors that such use
will not be of substantial detriment to adjacent property, that the character of the district will not be
changed thereby and that such use will be in harmony with the purpose and intent of this ordinance, with
the uses permitted by right in the district, with additional regulations provided in section 5.0 of this
ordinance, and with the public health, safety and general welfare."

Amendment sought will have no substantive change from SP 2006-015, but the use generally protects the viewsheds fi-onl^Monticello,
Montalto, Michie Tavern and the entrance corridors of Thomas .lefferson Parkway and interstate 64 by preserving open space
to a greater de;_rec than by -right development. The preservation of open space also has positive wildlife, water quality and env. impacts.

2006-015 which consisted of raising the Ie_v_elof the entrance to increase visibility in both directions. \'DO '.has determined that
it will not approve such modifications to the entrance because the modifications--cVron though deemed an impo4enlcnt will not
result in an entrance that fully complies with VDOT reqs. As of now, per the VDOT regs, the cnti1ance can continue to lie iisecf as is.
The second issue to be adclmssed in the amendment regarding the disturbance of critical slopes. The connector road between the
existing cemetery and the expansion area was designed to avoid the critical slope areas. The topographic data set used in the original
