Comments
Dear Steve:
I am responding to your letter to me dated December 19t" with advisory comments. I
will respond in the order in which you ask the questions and will utilize italics for
additional information.
1. Does proffer 2D allow retaining walls?
As you know, -the proffer does not directly mention retaining walls. The proffer does
state a maximum graded "steeper" slope of 2:1 with required plantings. I concur
with the Engineering comments that the proposed retaining walls are not consistent
with the proffer. The current proposal for several retaining walls at rear property
lines is not consistent with the approved plan.
2. Do Droffer 2A and 2G reauire features such as aaraaes. decks and entrances
are shown for each building site?
Yes, these features for a typical house plan need to be shown. The current building
site is not representative. The County is not asking for a specific house plan for
each lot. However, these proffers establish a master grading plan with maximum
grades, etc.
3. Can the aradina Dlan for this or future phases be revised in the future?
Yes. Any revised grading plan(s) must be done comprehensively and must follow a
similar process for County review and approval. For example, with the subsequent
phases of the subdivision approval, it is possible that the master grading plan may
be revised. If that occurs, the revisions (whether section 2 or 3 subdivision plat or
whatever) should be shown on the master grading plan that shows all of section 4C.
If changes are made after the plat is approved, they should again be made to the
master grading plan.

We would like to avoid a situation in which building on each individual lot warrants a
revised master grading plan. Maybe you have some ideas of how to best achieve
the purposes, avoiding a lot -by -lot revision and recognizing that final building plans
may differ from the "representative plans" shown on the master grading plan.
