Dickerson Virginia PCS Alliance DB /A NTELOS PROPOSAL: Request for approval of a treetop personal wireless service facility with a steel monopole that would be approximately 104.5 feet tall (10 feet above the height of the tallest tree within 25 feet), with a 54 -inch tall by 11 -foot 6 -inch long equipment sled that will be contained within a 625 square foot lease area. This application is being made in accordance with Section 10. 1.22 of the Zoning Ordinance, which allows for Tier II wireless facilities by right in the Rural Areas. The property is 2.00 +/- acres, described as Tax Map 58, Parcel 13A, and is located in the Samuel Miller Magisterial District. The parcel is zoned RA, Rural Areas. COMPREHENSIVE PLAN: The Comprehensive Plan designates the property as Rural Area in Rural Area 3. CHARACTER OF THE AREA: The proposed facility will be located approximately 262 feet north of Dry Bridge Road (State Route 708) in an area that is wooded [See Vicinity Maps, Attachment A]. Access to the facility will be from an existing gravel road (varying width) and a new 10 -12' wide gravel access to be installed at -grade. There is an existing dwelling on the site, and the nearest off -site dwelling unit to this site is approximately 170 feet northeast of the proposed facility site. PLANNING AND ZONING HISTORY: None available. STAFF COMMENT: Section 3.1 provides the following definitions that are relevant to this proposal: Tier II personal wireless service facility: A personal wireless service facility that is a treetop facility not located within an avoidance area. Treetop facility: A personal wireless service facility consisting of a self- supporting monopole having a single shaft of wood, metal or concrete no more than ten (10) feet taller than the crown of the tallest tree within twenty-five (25) feet of the monopole, measured above sea level (ASL), and includes associated antennas, mounting structures, an equipment cabinet and other essential personal wireless service equipment. Avoidance area: An area having significant resources where the siting of personal wireless service facilities could result in adverse impacts as follows: (i) any ridge area where a personal wireless service facility would be skylighted; (ii) a parcel within an agricultural and forestal district; (iii) a parcel within a historic district; (iv) any location in which the proposed personal wireless service facility and three (3) or more existing or approved personal wireless service facilities would be within an area comprised of a circle centered anywhere on the ground having a radius of two hundred (200) feet; or (v) any location within two hundred (200) feet of any state scenic highway or by -way. Section 5.1.40(d), "Tier 11 facilities" states: "Each Tier 11facility may be established upon commission approval ofan application satisfying the requirements of subsection 5.1.40(a) and demonstrating that the facility will be installed and operated in compliance with all applicable provisions of this chapter, criteria (1) through (8) below, and satisfying all conditions of the architectural review board. The commission shall act on each application within the time periods established in section 32.4.2.6. The commission shall approve each application, without conditions, once it determines that all of these requirements have been satisfied. If the commission denies an application, it shall identify which requirements were not satisfied and inform the applicant what needs to be done to satisfy each requirement. " The applicant has submitted an application that satisfies the requirements set forth in Section 5.1.40(a) and has performed a balloon test at the location of the proposed facility. The balloon test was conducted on January 9, 2009. Section 5.1.40(d)(1): The facility shall comply with subsection 5.1.40(b) and subsection 5.1.40(c)(2) through (9). Staff has determined that the proposed facility's location complies with all of the exemptions of Section 5.1.40(b) and the proposed equipment meets all relevant design, mounting and size criteria that are set forth in Section 5.1.40(c)(2) and (3). The remainder of subsection (c) provides requirements that are subject to enforcement if the facility is approved. Section 5.1.40(d)(2): The site shall provide adequate opportunities for screening and the facility shall be sited to minimize its visibility from adjacent parcels and streets, regardless of their distance from the facility. If the facility would be visible from a state scenic river or a national park or national forest, regardless of whether the site is adjacent thereto, the facility also shall be sited to minimize its visibility from such river, park or forest. If the facility would be located on lands subject to a conservation easement or an open space easement, the facility shall be sited to so that it is not visible from any resources specifically identified for protection in the deed ofeasement. The proposed facility includes a monopole that would have a height of approximately 104.5 feet above ground level (AGL) or 798.57 feet above mean sea level (AMSL). The height of the reference tree is approximately 788.57 feet above mean sea level (AMSL) and is located approximately 17 feet northwest of the proposed monopole. A balloon test was conducted on January 9, 2009. During the site visit, staff observed a test balloon that was floated at the approximate height of the proposed monopole. The balloon was not visible from some locations and slightly visible from other various locations. As the photos in Attachment D show, in some locations the balloon was visible through the trees; the test was performed in winter when there were no leaves on the trees. Where the balloon was visible above the trees, it was from a great distance and the balloon was almost imperceptible, or, it was seen for a short distance between a break in the tops of trees. Because no trees are to be removed during construction visibility of the tower is not expected to increase. In addition, the ground equipment is not expected to be visible, as it is proposed to be located behind an existing building. Furthermore, the equipment is proposed to be located within an existing stand of trees and painted "Java Brown" in color, thereby further diminishing its visibility. This low level of visibility is not expected to have a negative impact on adjacent properties or public streets. The balloon was highly visible from one location- immediately across Dry Bridge Road. The subject property is elevated compared to the road, therefore cars driving along Dry Bridge Road will see the embankment and not be able to see the tower. However, due to the cut in the embankment where the driveway is, the tower and balloon are clearly visible from directly across Dry Bridge Road. Screening is not provided due to the location of the driveway and gravel access drive, however the existing house will help screen the equipment at ground level. Additionally, the impact of visibility from the driveway and across the street will be minimized due to the color and size of the pole and antenna, and, all cabling and wires associated with the pole are required to be internal to the steel monopole. Together, these measures minimize the visibility of the facility. Section 5.1.40(d)(3): The facility shall not adversely impact resources identified in the county's open space plan. Staff's analysis of this request addresses the concern for the possible loss of aesthetic or historic resources. The proposed lease area is not delineated as a significant resource on the Open Space and Critical Resources Plan. Staff believes there is no significant loss of resources related to the installation of the facility. Records of the Virginia Department of Historic Resources show two surveyed resources in the immediate vicinity of the project area; neither of the properties has been evaluated for eligibility for listing on state or national registers, and neither property appears to retain its architectural integrity. There do not appear to be any significant landscapes or views associated with these resources. The proposed facility is not expected to have any significant impact on the setting or character of these resources. The County's wireless service facilities policy encourages facilities with limited visibility, facilities with adequate wooded backdrop, and facilities that do not adversely impact Avoidance Areas (including Entrance Corridors and historic resources). The proposed location is not within and will not be visible from an entrance corridor. A tree conservation plan, with measures limiting the impacts to existing trees remain will be submitted prior to application for the building permit, as required by the ordinance. Section 5.1.40(d)(4): The facility shall not be located so that it and three (3) or more existing or approved personal wireless service facilities would be within an area comprised of a circle centered anywhere on the ground having a radius of two hundred (200) feet. 0 There is no existing personal wireless service facility located within an area comprised of a circle centered anywhere on the ground having a radius of two hundred (200) feet. Section 5.1.40(d)(5): The maximum base diameter of the monopole shall be thirty (30) inches and the maximum diameter at the top of the monopole shall be eighteen (18) inches. Notes on the site plan for this facility propose a monopole diameter not to exceed 30 inches at the base or 18 inches at the top. These dimensions comply with the maximum width requirements for treetop monopoles serving Tier II facilities. Section 5.1.40(d)(6): The top of the monopole, measured in elevation above mean sea level, shall not exceed the height approved by the commission. The approved height shall not be more than seven (7) feet taller than the tallest tree within twenty-five (25) feet of the monopole, and shall include any base, foundation or grading that raises the pole above the pre - existing natural ground elevation; provided that the height approved by the commission may be up to ten (10) feet taller than the tallest tree if the owner of the facility demonstrates to the satisfaction of the commission that there is not a material difference in the visibility of the monopole at the proposed height, rather than at a height seven (7) feet taller than the tallest tree; and there is not a material difference in adverse impacts to resources identified in the county's open space plan caused by the monopole at the proposed height, rather than at a height seven (7) feet taller than the tallest tree. The applicant may appeal the commissioner's denial of a modification to the board ofsupervisors as provided in subsection 5.1.40(d)(12). As mentioned previously in this report, the proposed monopole would have a height of approximately 798.57 feet above mean sea level (AMSL). The height of the reference tree is approximately 788.57 feet above mean sea level (AMSL). The proposed monopole will be (10) feet taller than the tallest tree within twenty -five (25) feet. Based on field visits and photographs taken of the balloon test, there would be no material difference between a tower at the proposed height and one three (3) feet shorter. Section 5.1.40(d)(7): Each wood monopole shall be a dark brown natural wood color; each metal or concrete monopole shall be painted a brown wood color to blend into the surrounding trees. The antennas, supporting brackets, and all other equipment attached to the monopole shall be a color that closely matches that of the monopole. The ground equipment, the ground equipment cabinet, and the concrete pad shall also be a color that closely matches that of the monopole, provided that the ground equipment and the concrete pad need not be of such a color if they are enclosed within or behind an approved structure, fagade or fencing that: (i) is a color that closely matches that of the monopole; (ii) is consistent with the character of the area; and (iii) makes the ground equipment and concrete pad invisible at any time of year from any other parcel or a public or private street. The applicant is proposing the installation of a facility with a steel monopole. The proposed color for the tower is a brown paint (Sherwin Williams #4008 Umbra) to match existing surroundings. The proposed equipment sled will be a combination of brown metal siding (SW #4008 Umbra) [Attachment B]. Section 5.1.40(d)(8): Each wood monopole shall be constructed so that all cables, wiring and similar attachments that run vertically from the ground equipment to the antennas are placed on the pole to face the interior of the property and away from public view, as determined by the agent. Metal monopoles shall be constructed so that vertical cables, wiring and similar attachments are contained within the monopole 's structure. A note is provided on the site plan to indicate that vertical cables, wiring and similar attachments will be located inside the monopole. The regulation of the placement, construction and modification of personal wireless facilities by any state or local government or instrumentality thereof shall not prohibit or have the effect of prohibiting the provision ofpersonal wireless services. The Telecommunications Act addresses concerns for environmental effects with the following language, "No state or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commissions' regulations concerning such emissions." In order to operate the proposed facility, the applicant is required to meet the FCC guidelines for radio frequency emissions. These requirements will adequately protect the public health and safety. It is staffs opinion that the denial of this application would not have the effect of prohibiting the provision of personal wireless communication services. RECOMMENDATION: Staff recommends approval of this personal wireless service facility. Based on findings presented in the staff report, staff recommends approval at 10 feet above the reference tree. SUMMARY: Staff has identified factors which are favorable and unfavorable to this proposal: Factors favorable to this request include: 1. The lease area for the ground equipment and monopole are not located on significant features identified in the Open Space Master Plan. 2. The facility has limited visibility from surrounding areas and where the site is visible, the design of the facility minimized visibility. Factors unfavorable to this request include: The facility is visible from the bottom of the driveway and from the residences across the street. * In order to comply with Section 5.1.40(d) of the Zoning Ordinance, the Planning Commission is required to provide the applicant with a statement regarding the basis for denial and all items that will have to be addressed to satisfy each requirement. 0 ATTACHMENTS: A. (` NTELOS') requests the consideration of the Albemarle County Planning Commission for the construction of a personal wireless service facility by NTELOS located on property owned by Mary I. and Robert W. Dickerson described as tax parcel 58 -13A, containing approximately 2.00 acres, and zoned Rural Areas (RA) in the Samuel Miller Magisterial District. The property is not located within an Entrance Corridor. The proposed facility is located at 1108 Dry Bridge Road south of Rt. 250 (Ivy Road). NTELOS is in the process of improving its existing services along Rt. 250 just west of the blinking caution light at Ivy (propagation map #1). The proposed personal wireless service facility shall follow the Tier II treetop facility guidelines as set forth in the Personal Wireless Service Facility Guidelines Policy (`the Policy') adopted by Albemarle County. Attached is a site plan of the location and design of the proposed facility. The proposed Tier II treetop facility shall include a steel monopole painted brown, 104.07 ft. in height, with a top elevation of 798.57 ft. Above Mean Sea Level. The proposed monopole shall be 10 ft. taller than the 97 ft. tall scarlet oak tree identified on the site plan as the reference tree ( #20) with a top elevation of 788.57 ft. Above Mean Sea Level. The base of the monopole is 3 ft. higher in elevation than the reference tree. The monopole will have a flush - mounted antenna array consisting of three (3) panel antennas measuring 72.4 in. (L) x 6.3 in. (W) x 3.3 in. (D) each. The antennas shall not project more than twelve (12) inches from the facility. The antennas and cabling will be painted brown to further camouflage the facility. The proposed ground equipment will be located within the 25 ft. x 25 ft. leased compound area. NTELOS will access the proposed facility by the existing driveway access to the home off Dry Bridge Road. Attached is a Tree Conservation Plan developed by Bartlett Tree Experts as required by the Policy. The Plan recommends the removal of only two (2) trees within 25 ft. of the 10 Attachment 8 proposed facility ( #108 and #110) due to significant decay. No other trees shall be removed. The proposed facility is located within a wooded area and will blend in with the natural environment. There will be no tree removal for additional ingress/egress access. While it is the goal of Albemarle County to protect its natural, scenic and historic resources and to retain the attractiveness of the County, the proposal by NTELOS has been maintained by complying with the guidelines established by the Policy. The brown monopole type flush - mounted design, the height above the tree tops and the strategic location of the facility are designed to minimize the visibility of the facility while still providing significant improvement to the NTELOS coverage objective (propagation map #2). The balloon test conducted at 7 ft. above the reference tree indicates the proposed facility would appear only minimally from Rt. 250 (Ivy Road) and Rt. 738 (Morgantown Road). The design of the proposed facility is compatible with the area's rural setting. A determination from the Virginia Department of Historic Resources has been requested but not yet received. The proposed facility is located within a grove of deciduous trees behind the home on the property. The view from Rt. 708 (Dry Bridge Road) is mitigated by the deciduous trees on the subject parcel as well as adjacent properties, which will help it blend in, and thus minimizing the view of the facility. While conducting a balloon test, the visibility of the balloon was minimal and at a great distance from Rt. 250 through a row of deciduous trees along the roadside, minimally along Rt. 738 (Morgantown Road) and at the intersection of Rt. 738 (Morgantown Road) and Rt. 676 (Tilman Road) near the blinking yellow light (photo simulations #1 -5). Once constructed, the proposed facility will be visited approximately 1 -2 times per month for normal routine maintenance checks. Outdoor lighting for the facility shall be only used during maintenance checks. The proposed facility is fully consistent with the County's Wireless Telecommunications Policy. It is a treetop monopole structure, has flush mounted antennas, has minimal visual impact on the surrounding area, and provides adequate height and coverage objective for NTELOS. As a personal wireless service facility, this proposal will serve the public health and safety needs to the community by providing increased communication coverage in this well traveled area. The plan is designed to specify the necessary tree protection methods and procedures required to minimize construction stress on the trees that will be impacted by this project, as well as to identify existing hazardous trees that are recommended for removal. Trees are recommended for removal when they are located within 1.5 times their height from the proposed structure and meet the following criteria: o The tree is dead or in irreversible decline. o The tree is an unreasonable risk due to a structural defect that cannot be reduced to a reasonable risk level through the implementation of standard arboricultural practices. This particular site is unique in that the pole will be located near a house, Minimal site disturbance and impact is expected due to easy access to site Two trees have significant decay and should be removed to avoid risk of damage to person and property, I have developed a table that describes each tree species, specific recommendations for their care, and any relative comments. The required tree protection procedures are broken up into 3 categories, pre- construction, during construction, and post- construction. The zone will be defined as an area that is 9 inches times the diameter at breast height (DBH) away from any tree to be protected. o A 4 foot high, orange, UV- resistant, high - tensile strength, barricade fabric fence shall be installed to define the Tree Protection Zone and limit access. During Construction o The Tree Protection Zone will be inspected and maintained on a daily basis. • Trees shall be inspected on a regular basis by a certified Arborist to evaluate for construction trauma, as well as for secondary pest and disease concerns, and irrigation needs. • No construction equipment, supplies or debris will be allowed in the Tree Protection Zone. o Trenching or excavation within the Tree Protection Zone will not be allowed without consultation with certified Arborist and will require specialized equipment to perform proper root pruning. o Root pruning will be performed under the supervision of a certified Arborist and l will be performed in such a manner, and with equipment designed to cut &0 BARTLETT i through roots cleanly, so as not to tear roots. If roots greater than 2 inches in diameter are encountered during root pruning, they shall be traced back towards the tree using an air -spade and pruned by hand at a point specified by the Arborist. o Grade changes around trees shall be avoided. Excess soil and debris must be removed from site. Post - construction o Tree protection fencing shall be removed. o The following trees shall be fertilized based on specific needs as determined by soil analysis. Fertilization should include Mycorrhizae inoculation for mature trees, and should be applied using the sub - surface soil injection method. Trees # 100 -130 o Trees that have been affected by construction shall be pruned to remove any dead or damaged limbs. Any bark wounds shall be traced to promote wound closure. o Trees shall be inspected during the growing season following construction by a certified Arborist to evaluate for construction trauma, as well as for secondary pest and disease concerns, and irrigation needs. The inspection period will extend for up to 18 months following completion of construction.
