Simpson Bohler Engineering, P.c. 20164 Davis Drive, Suite 200 Sterling, VA 20164 RE: SP 2005-017 Chick-FiI-A (Route 29) - Signs #60&66 Tax Map 45 - Parcel 93A Dear Mr. Simpson: On October 5, 2005, the Albemarle County Board of Supervisors took action on SP 2005-017 to allow a drive-in window serving a fast food restaurant, in accordance with Section 24.2.2.13 of the Zoning Ordinance, on Tax Map 45 - Parcel 93A in the Rio Magisterial District. This special use permit was approved based on the following conditions: 1. Development shall be in general accord with the site plan titled "Chick-Fil-A Preliminary Site Plan Documents", last revised July 8, 2005 and initialed SBW on August 22, 2005; 2. The existing evergreen hedges and trees along Woodbrook Drive and the Route 29 North EC shall remain fully intact and allowed to reach mature height and habit typical of the species. Pruning shall be limited to the correction of damage and the overall maintenance of the health of the plantings; and 3. The color and material of the awning on the drive-through elevation shall be resolved to the satisfaction of the ARB and a Certificate of Appropriateness issued. Please be advised that although the Albemarle County Board of Supervisors took action on the project noted above, no uses on the property as approved above may lawfully begin until all applicable approvals have been received and conditions have been met. This includes: · compliance with conditions of the SPECIAL USE PERMIT; · approval of and compliance with a SITE PLAN; and · approval of a ZONING COMPLIANCE CLEARANCE. In the event that the use, structure or activity for which this special use permit is issued is not commenced within twenty-four (24) months from the date of Board approval, it shall be deemed abandoned and the SP 2005-0] 7 Chick-fil-A Page 2 of2 October 13,2005 permit terminated. The term "commenced" means "construction of any structure necessary to the use of the permit."
