[32.5.2(a)] Setbacks. On the cover sheet of the plan assure that the setbacks for the water tank are listed as 1 to 1 based on the height of the tower. As proposed the site requires two special exceptions both to reduce the required setbacks to property lines (rear and side). A request has been submitted and is being processed. Prior to final site plan approval the special exceptions should be listed on the cover sheet of the site plan to include their approval date. Rev 3. The Special Exception for setbacks was approved on Dec 3, 2014 by the BOS. Assure the following note is provided on the cover sheet of the site plan under setbacks: "Setbacks for the Water Tank are 1 to 1 based on tank height. The tank is 35' tall. Special Exception was approved on Dec 3, 2014 by the BOS to allow a 32 foot side setback and a 20 foot rear setback subject to the following conditions: 1. The Albemarle County Service Authority (the "Authority ") shall obtain a landscaping easement (the "Landscaping Easement") on Tax Map and Parcel Number 093A1- 00 -00- 00400 in the location shown for the "Prop. 20' Landscaping Easement" on the Site Plan — Grading Plan and Landscaping Plan (the "Plan" ), last revise Novem er 4, -2014, - — - attached hereto, subject to the following: A. Any tree shown on the Plan whose trunk is located within the Landscaping 1 Easement shall be preserved and maintained by the Authority; B. If any tree within the Landscaping Easement dies, is removed, or is otherwise cut so as to no longer provide the screening intended by this condition as determined by the Director of Community Development, the Authority shall promptly submit a landscape plan that complies with Albemarle County Code § 18- 32.7.9 and which will provide screening as provided by Albemarle County Code § 18- 32.7.9.7; C. After the landscape plan is approved by the County, the Authority shall install and thereafter maintain.any landscaping shown on the approved landscape plan; D. Existing trees may be preserved in lieu of planting new plant materials in order to satisfy the landscaping and screening requirements of section 32.7.9 subject to the agent's approval. Specifically some of the existing trees within the proposed 20' landscaping easement are between 20' - 80' tall and have a mix of deciduous and evergreen trees present. Please verify the above on the site plan on the existing conditions page and landscape-plan. Upon verification, it may be appropriate for the existing trees to be preserved as undisturbed buffer area, as mature trees will provide superior screening of the tower from day one. If the existing mature trees within the 20' landscape easement are determined by the Agent to be adequate to screen the facility the following shall be followed: The landscape plan should show the trees to be preserved, the limits of clearing, the location and type of protective fencing, grade changes requiring tree wells or walls, and trenching or tunneling proposed beyond the limits of clearing. In addition, the applicant shall sign a conservation checklist approved by the agent to insure that the specified trees will be protected during construction. Except as otherwise expressly approved by the agent in a particular case, such checklist shall conform to specifications contained in the Virginia Erosion and Sediment Control Handbook, pp III -284 through III -297, and as hereafter amended. This checklist must be signed, dated and included on the plans. Rev 3. On sheet 6 please omit the previously requested note to avoid conflict with the conditions of the Special Exception approval by the Board of Supervisors. Remove the following note from the plan: "If the existing preserved trees within the 20 foot offsite landscape easement are cut down or die, the easement holder (ACSA) shall be required to revise the site plan to plant the required screening per section 32.7.9.7 of the Albemarle County Ordinance. Existing trees may be preserved in lieu of planting new plant materials in order to satisfy the landscaping and screening requirements of section 32.7.9 subject to the agent's approval. Specifically some of the existing trees within the proposed 20' landscaping easement are between 20' - 80' tall and have a mix of deciduous and evergreen trees present. Please verify the above on the site plan on the existing conditions page and landscape plan. Upon verification, it may be appropriate for the existing trees to be preserved as undisturbed buffer area, as mature trees will provide superior screening of the tower from day one. If the existing mature trees within the 20' landscape easement are determined by the Agent to be adequate to screen the facility the following shall be followed: The landscape elan should show the trees to be preserved, the limits of clearing, the location and type of protective fencing, grade changes requiring tree wells or walls, and trenching or tunneling proposed beyond the limits of clearing. In addition, the applicant shall sign a conservation checklist approved by the agent to insure that the specified trees will be protected during construction. Except as otherwise expressly approved by the agent in a particular case, such checklist shall conform to specifications contained in the Virginia Erosion and Sediment Control Handbook, pp 111 -284 through 111 -297, and as hereafter amended. This checklist must be signed, dated and included on the plans. Rev 1. The existing mature trees are adequate for screening purposes and shall be preserved in the off site 20 foot landscape easement area for screening purposes. Due to the planned grading of the adjacent lot, this site plan shall provide a note on the landscape plan that states, "If the existing preserved trees within the 20 foot off site landscape easement are cut down or die, the easement holder (ACSA) shall be required to revise the site plan to plant the required screening per section 32.7.9.7 of the Albemarle County Ordinance." Also, it is advisable that the existing preserved trees canopy's be depicted more accurately on the site plan. This modification will help the Board of Supervisors see the true amount of screening when considering the special exception request. 4 35. [32.6.20) & 32.7.9.4(b), 32.7.9.7(d)] Minimum depth and spacing requirements for a planting strip or existing vegetation. If only a planting strip or existing vegetation is provided as screening, the planting strip or the existing vegetation shall not be less than twenty (20) feet in depth. If a planting strip is provided, the plant materials shall consist of a double staggered row of evergreen trees planted fifteen (15) feet on center, or a double staggered row of evergreen shrubs planted ten (10) feet on center, or an alternative vegetative screening approved by the agent. To meet the above requirement the landscape plan shall be revised as follows: Within the side yard, replace all the `Nellie Stevens Holly' with evergreen trees, it may be appropriate to continue utilizing `leyland cypress' in place of the `Nellie Stevens Holly' or the applicant may choose to utilize some other approved evergreen tree. Revise to assure double staggered row of evergreen trees planted 15' on center. Also, assure that this planting strip is a minimum of 20' deep, currently its only 14' deep. Also continue the planting strip another 25 feet to the other side of the `Altitude and Pressure Sustaining Valve Vault Assembly' to completely screen the tower from the road. Revise. Rev 1. Comment addressed, staff can approve the Leyland Cypress plantings as depicted; however, per discussions with Elaine Echols and Ellie Ray (Landscape Architect) they recommend that the double staggered row of Leyland Cypress be replaced with a mix of (Pinus Strobus Eastern White Pine) and (Cryptomeria japonica & cvs), at a min of 4 foot tall at time of planting. This is being recommended as Leyland's are knownrto fall down due to wind and are known to sustain substantial damage due to ice. Also the mix of the two evergreen tree types is being recommended to aid in the appearance of a more natural look.
