(The following comments are those that have been identified at this time. Additional comments or conditions may be added or eliminated based on further review.) Planning 1. [Section 14- 302(B)(7)] Please add a note to indicate "This property lies in a water protection area and specifically lies in the South Fork Rivanna Reservoir water supply watershed." Please additionally note that "This property does not lie in an agricultural /forestal district." 2. [Section 14 -316] Please forward evidence of VDOT approval of the entrance onto the public street. 3. [Section 14 -317] Please provide a maintenance agreement for the proposed private street for review and approval by the County Attorney's office. Please also remove Notes 6 and 7. The County Attorney's office prefers that these notes be included in the maintenance agreement as opposed to being shown on the plat. Staff has provided references to provisions of Chapter 14 of the Albemarle County Code. The Code is kept up to date by the County Attorney's office and can be accessed through their department's website at www.albemarle.org. In accord with the provisions of Section 14- 229(B) of Chapter 14 of the Code, if the developer fails to submit a revised final plat to address all of the requirements within six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
