Subject: SUB 201400076 Northtown — subdivision after final site plan approval

The County of Albemarle Planning Division will grant or recommend approval of the subdivision plat
referenced above once the following comments have been addressed: [Each comment is preceded by the
applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise specified.]
1. [14- 302(A)1) Existing or platted streets. Label Gander Drive.
Rev1: Comment addressed.
2. [14- 302(B)1] Reservoir watershed, agricultural forestal district. Include notation stating that land is not
within a water supply watershed.
Rev1: Comment addressed.
3. [14- 303(A)] Statement of consent to division. Under the owner's approval include parcel numbers
110A, 111, and 111B in the description of subdivided land.

4. [14 -311 & 14 -403] Infrastructure improvement plans, computations and documents; lot frontage. Each
lot within a subdivision must have frontage on an existing or proposed street. Proposed Parcel C does
not have road frontage on an authorized street. This subdivision plat cannot be approved until road
plans have been submitted and approved for the proposed street and the private street has been
authorized by staff.
Rev 1: Comment not fully addressed. Review of road plans still pending.
[14 -317] Instrument evidencing maintenance of certain improvements. If the subdivision will contain
improvements that are not to be maintained by the county or any authority or other public agency,
you must submit instrument assuring the perpetual maintenance of the improvement. New easements
shown on the plat that will need to be maintained (such as drainage easements, biofilter access
easement, and private street access easement) require maintenance agreements to be reviewed by
the county attorney and recorded with the plat. If a maintenance agreement already exists for Gander
Drive it will need to be updated to reference this plat.
Rev 1: Comment not addressed:
a) The 40' drainage easement should be a private easement and should not be dedicated to
public use.
b) Provide a deed for the 20' biofilter access easement. A sample deed of dedication can be
found here.
c) The stormwater maintenance agreement should be updated to reflect the proposed division
and submitted for review.
d) Gander Drive requires a private street maintenance agreement. If one already exists it
should be updated to reference this plat and provided for review. If not, a new maintenance
agreement should be submitted for review. A sample private street maintenance agreement
can be found here.
6. [Comment] This subdivision cannot be approved until Engineering, ACSA, Fire Rescue, and E911
complete their reviews and grant their approval. E911 and Fire Rescue have no objections to the
proposed plat. ACSA comments are attached. Engineering comments, if any, will be forwarded upon
receipt.
