Dear Alan, Staff has reviewed your initial submittal for your request for a special use permit for outdoor storage of equipment in the Entrance Corridor Overlay District. We understand that you wish to increase the size of the equipment storage area that is currently proposed in the initial submittal. A revised plan illustrating this expanded storage area and related changes will be required, but I am forwarding you the comments that are available on your current plan at this time. Some of these comments are not required to be addressed until the site plan submittal, but you may wish to incorporate them into your revised Special Use Permit plan since you will already be making changes. We will need the revised plan showing the expanded storage area and related changes in order to schedule ARB review of the proposal. ARB review is required prior to review by the Planning Commission. The revised plan will also be redistributed to the special permit reviewers. We would be glad to meet with you to discuss our comments and scheduling if you wish. Planning Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below. Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and Board of Supervisors as part of the staff report. The Comprehensive Plan shows this area as industrial service in Neighborhood 4. This designation includes warehousing, light and heavy industry, research, office uses, regional scale research, limited production and marketing activities, and supporting commercial uses. The proposed use is similar in type and scale to the designated uses. The Comprehensive Plan (Chapter 2, Natural Resources and Cultural Assets) establishes the goals for preserving the scenic resources that are essential to the County's character, economic vitality and quality of life. The Entrance Corridor Overlay District is intended to support that goal by maintaining the visual integrity of the County's roadways. The Architectural Review Board addresses potential adverse aesthetic impacts in the Entrance Corridors by applying the County's Entrance Corridor Design Guidelines during their review of development proposals. ARB review of the proposal for conformance with the Design Guidelines will be scheduled when the revised plan is received. Zoning Comments frolm the Zoning Division will be forwarded as soon as they are available. Current Development Comments from Current Development will be forwarded as soon as they are available. Engineering and Water Resources The following comments related to engineering and water resources have been provided by Max Greene: No objection. Building Official The following comments are provided by Jay Schlothauer, the Building Official: No objection. Entrance Corridor The following comments related to the Entrance Corridor Guidelines have been provided by Margaret Maliszewski: We understand that the applicant wishes to increase the size of the equipment storage area from that which is shown on the current plan. ARB review of the expanded proposal will be scheduled when a revised plan is received. It is anticipated that the revised plan will show increased planting area corresponding to the increased storage area. Detailed ARB comments and an ARB recommendation on the Special Use Permit will be provided at the ARB meeting. ARB approval of the site plan will be required prior to Final Site Plan approval. VDOT The following comment for VDOT have been provided by Troy Austin: As it pertains specifically to the SUP request, I have no objection to Virginia Asphalt. My understanding from Mark Keller's letter is that the SUP is required to have outside storage. The entrance will need to meet VDOT standards. The entrance will be dealt with during the site plan review. ASCA /RWSA The following comments from RWSA have been provided by Victoria Fort: 1. Capacity issues for sewer that may affect this proposal: None Known 2. Requires Rivanna Water and Sewer Authority Capacity Certification: No 3. Water flow or pressure issues that may affect this proposal: None Known 4. "Red Flags" regarding service provision: None Known Fire /Rescue The following comments from Fire /Rescue have been provided by Robbie Gilmer: Fire Rescue is requesting a new fire hydrant be installed at the entrance to the parking lot. This will allow the structure to meet the fire code requirements for travel distance to a hydrant. The maximum travel distance shall be no more than 500 ft per travel way. Health Department The following comments from the Health Department have been provided by Josh Kirtley: If the proposed building is to be served by public water and public sewer, I have no concerns. If they are proposing to utilize a well and septic system, then they should submit plans as to the location and preliminary design to ensure that the project is feasible. While reviewing your septic permit application, I note that there is an existing well on the property that your engineer states will need to be abandoned due to its proximity to the proposed drainfield. This email is to inform you that the well will need to be abandoned prior to receiving your septic approval. I have no issues with the septic design, and the approval will be issued as soon as the well is abandoned. Please complete the [required] application and return either in person or by email so that a site visit can be arranged to conduct the necessary field work required to issue the abandonment permit. It is important to note that an application fee of $350.00 applies to the application as it is a well abandonment only. SP Conditions At this point in the review process, we anticipate that recommended conditions of approval for the Special Use Permit will include those conditions recommended by the Architectural Review Board. Those conditions will likely relate to location of equipment storage, height of equipment to be stored, and landscaping. We will know more about the ARB's recommended conditions following ARB review of your revised plan. Please note that reviewers' comments could change based on your revisions to the plan, so other SP conditions could arise that are not known at this time. Action after Receipt of Comments After you have read this letter, please take one of the actions identified on "Action After Receipt of Comment Letter" which is attached. Resubmittal If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal. The resubmittal date schedule is provided for your convenience. Notification and Advertisement Fees Recently, the Board of Supervisors amended the zoning ordinance to require that applicants pay for the notification costs for public hearings. Prior to scheduling a public hearing with the Planning Commission, payment of the following fees is needed: $140.50 Cost for newspaper advertisement 200.00 Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per owner after 50 adjoining owners) 3 $ 340.50 Total amount due prior to Planning Commission public hearing Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the Board hearing needed. $ 140.50 Additional amount due prior to Board of Supervisors public hearing $ 481.00 Total amount for all notifications Fees may be paid in advance. Payment for both the Planning Commission and Board of Supervisors public hearings may be paid at the some time. Additional notification fees will not be required unless a deferral takes place and adjoining owners need to be notified of a new date. The full resubmittal schedule may be found at www.albemarle.org in the "forms" section at the Community Development page. Be sure to include the resubmittal form on the last page of your comment letter with your submittal. The application fee which you paid covers staff review of the initial submittal and one resubmittal. Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.) (2) Request Indefinite Deferral If you plan to resubmit after 30 days from the date of the comment letter, you need to request an indefinite deferral. Please provide a written request and state your justification for requesting the deferral. (indefinite deferral means that you intend to resubmit /request a public hearing be set with the Planning Commission after the 30 day period.) (3) Request Planning Commission Public Hearing Date be Set At this time, you may schedule a public hearing with the Planning Commission. However, we do not advise that you go directly to public hearing if staff has identified issues in need of resolution that can be addressed with a resubmittal. After outstanding issues have been resolved and /or when you are ready to request a public hearing, staff will set your public hearing date for the Planning Commission in accordance with the Planning Commission's published schedule and as mutually agreed by you and the County. The staff report and recommendation will be based on the latest information provided by you with your initial submittal or resubmittal. Please remember that all resubmittals must be made on or before a resubmittal date. By no later than twenty -one (21) days before the Planning Commission's public hearing, a newspaper advertisement fee and an adjoining owner notification fee must be paid. (See attached Fee Schedule) Your comment letter will contain the actual fees you need to pay. Payment for an additional newspaper advertisement is also required twenty -two (22) days prior to the Board of Supervisors public hearing. These dates are provided on the attached Legal Ad Payments for Public Hearings form. Please be advised that, once a public hearing has been advertised, only one deferral prior to the Planning Commission's public hearing will be allowed during the life of the application. The only exception to this rule will be extraordinary circumstances, such as a major change in the project proposal by the applicant or more issues identified by staff that have not previously been brought to the applicant's attention. As always, an applicant may request deferral at the Planning Commission meeting. (4) Withdraw Your Application If at any time you wish to withdraw your application, please provide your request in writing. Failure to Respond If we have not received a response from you within 30 days, we will contact you again. At that time, you will be given 10 days to do one of the following: a) request withdrawal of your application, b) request deferral of your application to a specific Planning Commission date as mutually agreed to with staff, or c) request indefinite deferral and state your justification for requesting the deferral. If none of these choices is made within 10 days, staff will schedule your application for a public hearing based on the information provided with your original submittal or the latest submittal staff received on a resubmittal date. The reviewing planner will contact applicant to discuss comments of reviewers and advise that changes that are needed are significant enough to warrant an additional submittal or advise that the the project is ready for a public hearing. If changes needed are minor, the planner will advise that the project go to public hearing. The legal ad deadline is the last date at which an applicant can decide whether to resubmit or go to public hearing. If an applicant decides to go to public hearing against the advice of the reviewing planner, a recommendation for denial will likely result. Generally, the applicant will will have only one opportunity to defer the PC public hearing for the project once it has been advertised for public hearing.
