Re: Rivanna Quarry Entrance at the Stackhouse Site — determination for
site plan requirement
Dear Mr. DeNunzio:
I've received your letter dated May 20th on this subject. Before we can determine if the
proposed use is exempt from the requirement of a site plan, we need to clarify the
entrance analysis by VDOT.
The relevant Ordinance language to this determination is included below:
32.2 WHEN REQUIRED
32.2.1 A site plan shall be required for any construction, use, change in use or other development
in all zoning districts; provided that no site plan shall be required for the following:
e. Any change in or expansion of a use provided that: (1) such change or expansion does not
occasion additional parking under the requirements of this chapter; (2) no additional
ingress /egress or alteration of existing ingress /egress is recommended by the Virginia
Department of Transportation based on intensification of use; (3) no additional
ingress /egress or alteration of existing ingress/ egress is proposed. (32.2.1, 1980) (Bold
emphasis added)
It is our position that the proposal to add the new quarry traffic to the existing
Stackhouse entrance is an intensification of the use of that entrance. To the extent that
you can respond with a yes or no, that would be helpful.
Our questions are as follows:
1. Does the Virginia Department of Transportation (VDOT) recommend either
additional ingress /egress or an alteration of existing existing /egress to serve the
proposed use?

2, Does the proposed additional use of the existing entrance require VDOT to issue
an entrance permit or a permit to modify or improve the entrance?
3. Will or can VDOT place any restrictions on the direction that trucks accessing
this site will travel along Rio Mills Road (north versus south)? j
We appreciate your response to these questions. We want to be certain to follow the
Ordinance and to understand VDOT's analysis. We also want the permanent / written
record to reflect our deliberate consideration under the Ordinance provisions. If you
