Jefferson Street Charlottesville, VA 22902 RE: Request, dated October 10, 2008, to further vary trail locations from what was originally shown on the Redfields approved plan from ZMA 1989 -18 and ZMA 2001 -01 Redfields Development and subsequently varied on September 8, 2008 Dear Mr. Beights: The County has received your second variation request referenced above and shown on the attached Redfields plan, prepared by Kirk Hughes & Associates and dated February 5, 2009. The revised trail system includes the existing asphalt pathway, shown in blue on the plan, the new nature trail, shown in red, and the portion of the trail connection that is the existing road, shown in yellow. Staff understands the request to relocate the trails within the Redfields subdivision as shown on the attached plan is based on two factors: (1) the previously approved trail variation shows a connection adjacent to a property located on Pebble Hill Court whose owner is not in agreement with the trail location being so close to his house, particularly since this was not the original approved location of the trail when he purchased his property; and, (2) the homeowner's association, while eager to see the completion of this trail system, requests some revisions be completed to make the trail system more easily accessible to residents. Because the topography of portions of the Redfields subdivision is quite steep, you and the homeowner's association have proposed revised portions of the trail location in order to make the trail system more accessible to as many of the residents as possible. The analysis of the new variation request is provided below and is consistent with the findings for the originally approved September 8 variation. Section 8.5.5.3 allows the director of planning to grant minor variations from the approved plan as long as: 1) The variation is consistent with the goals and objectives of the comprehensive plan. The variation is consistent with the goals and objectives of the comprehensive plan. Pedestrian pathways and connections are encouraged in the Comprehensive Plan as a means of alternative transportation and recreation for residents. 2) The variation does not increase the approved development density or intensity of development. The variation will not increase the approved density or intensity of development. The number of lots and units remains the same. 3) The variation does not adversely affect the timing and phasing of development of any other development in the zoning district. The variation does not affect any timing or phasing of this or any other development. 4) The variation does not require a special use permit. The variation does not require a special use permit. 5) The variation is in general accord with the purpose and intent of the approved rezoning application.
