Dear Ms. LaCour:
The Albemarle County Planning Commission, at its meeting on January 6, 2009, approved a modification
for the above -noted petition by a vote of 6:0, of Section 4.1.11(b) to allow a veterinary office to be located
in a building less than 200 feet from R -6 zoned property line to the east to the Board of Supervisors.
Please note that this approval is subject to the following conditions:
1. A separate entrance and exit shall be provided for the clinic in accordance with Section 5.1.11.d;
2. No outdoor exercise area shall be permitted;
3. The veterinary clinic shall be located in Building 4, as shown on the plan entitled "Application Plan for
Luxor Commercial Center ", prepared by Rivanna Engineering, dated October 13, 2004, last revised
July 25, 2004;
4. Architectural Review Board issuance of a Certificate of Appropriateness; and
5. Special Use Permit 2008 -059 shall be valid for forty -eight (48) months from its date of approval.
Please be advised that the Albemarle County Board of Supervisors will review this petition and receive
public comment at their meeting on February 14, 2009.
