Subject: SUB201400165 Old Trail Creekside III, Phase IIIC - Final
The County of Albemarle Planning Division will approve the plat referenced above once the following comments
have been satisfactorily addressed (The following comments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.): [Each comment is
preceded by the applicable reference, which is to the Subdivision /Zoning Ordinances unless otherwise
specified.]
1. [14- 302(A)4] Private easements. The sidewalk and landscape easement labeled as 12.5' wide appears to
reduce to 10' in width as it turns the corner to Birchwood Hill Road; label the 10' wide section accordingly.

2. [14- 302(A)4] Private easements. The required landscape buffer should not be in an easement on
proposed private property, it should be entirely within open space. Revise Lot 54 to eliminate all required
buffer area. Since the open space is to be dedicated to the County, an easement will be required for the
homeowner's association to maintain the buffer. Additionally, the deed of dedication and /or declaration
should state that the homeowner's association is responsible for maintaining the buffer.
Rev1: Comment not fully addressed. The buffer easement should be conveyed to the Old Trail
Community Association, not Albemarle County (Albemarle County will own the land; the
Association is responsible for maintaining the required buffer). Revise easement note 3. As noted
above, the declaration should also indicate that the HOA is responsible for buffer maintenance.
Rev2: Comment not fully addressed. Easement notes 3 and 7 appear to reference the same area
and say the same thing; please remove one. The declaration has been reviewed by the County
Attorney's Office and their comments have been provided. Keep in mind that the last revision date
on the plat, once it is deemed approvable, is what is required in the declaration.
3. [14- 302(A)4] Private easements. The sidewalk and landscape easement should wrap around the cul -de-
sac all the way to the right -of -way extension. A maintenance agreement shall also be submitted for review
for all sidewalk and landscape easements; as with previous phases, a supplemental declaration should be
sufficient.
Rev1: Comment not fully addressed. A maintenance agreement for all sidewalks and landscape
areas must be submitted for review and approval.
Rev2: Comment not fully addressed. See above for information regarding the supplemental
declaration.
4. [14- 302(A)4] Private easements. Both easements labeled (1) and (3) in the Easement Notes are indicated
as "20' Sanitary Sewer Easement to be Dedicated to ACSA" but the plat doesn't show any easements with
the label (3); please clarify.

5. [14- 302(A)4] Private easements. The approved road plans show a greenway between lots 52 and 53.
Label the area for the greenway trail as a greenway easement in all areas where it crosses out of dedicated
public land and into individual lots. A Deed of Greenway Easement will also be required for these areas.

6. [14- 302(A)4 &5] Private and public easements. There is a new easement proposed on Lot 16 from Phase
IIC. Label this parcel with the appropriate TMP and owner information. This parcel should also be included
in the information on the Cover Sheet and the owner must sign this plat.

7. [14- 302(A)4 &5] Private and public easements. There is a new easement proposed on TMP 055EO- 04 -00-
00000, which is owned by the County. Label this parcel with the appropriate TMP and owner information.
This parcel should also be included in the information on the Cover Sheet and the owner must sign this plat.
Clarify with Engineering and /or the County Attorney's Office if a stormwater facility will be permitted on land
owned by the County; a portion of this parcel may need to be conveyed to the homeowners association. If
the land does stay in County ownership the easement labeled as (5) "variable width drainage, access, and
stormwater management easement hereby dedicated to public use" should really be conveyed to the
homeowner's association as the public already owns the parcel and the association is responsible for the
maintenance.
Rev1: Comment not addressed. The County Attorney's Office has indicated that the County will not
permit the SWM facility on County owned land. The parcel dedicated to the County with a previous
phase, TMP 055EO- 04- 00- OOOCO, will need to be partially vacated with this plat. The land where the
SWM facility is located should be conveyed to the Old Trail Community Association. A declaration
of vacation must also be submitted for review and approval. See provided templates.
Rev2: Comment not fully addressed. Since the 0.611 acre of land within the SWM area is now being
vacated and conveyed to the Old Trail Community Association, an easement to the Old Trail
Community Association is not necessary; remove easement note 5. The SWM Maintenance
agreement coordinated through engineering provides the necessary access for the County, so no
additional easement is necessary. Revise the plat to clearly show that 0.611 acres of TMP 055EO -04-
00-00000 is becoming a new parcel and that the existing open space parcel is losing acreage (2.55 —
0.611 = 1.939 acre). The quitclaim deed was forwarded to the County Attorney's Office for review
and their comments have been provided.
8. [14- 302(A)11] Instrument creating the property for subdivision. Add the Deed Book and Page Number for
the open space parcels created with Phase I I I B (once recorded) or label the parcels as part of Phase IIIB.
Also, provide the instrument for the two parcels on which easements are proposed.
Rev1: Comment not fully addressed. Once Phase IIIB is recorded, add the DB and PG reference.

9. [14- 302(A)14] Land to be dedicated in fee or reserved. For any land intended to be dedicated to the
County, provide a Deed of Dedication for review and approval by the County Attorney's Office. This deed
must be recorded with the plat.
Rev1: Comment not addressed. Provide a Deed of Dedication for review, approval and signature.
Rev2: Comment not fully addressed. The Deed of Dedication was forwarded to the County
Attorney's Office for review and their comments have been provided. Once approved, it must be
signed by the County Executive.
10. [14- 303(8)6] Tax map and parcel number. It appears that the TMP for this parcel has been changed back
to 05500- 00 -00- 07800; please change all TMP references to this number. Add TMP and owner information
for the two parcels impacted by proposed easements to the cover sheet.

11. [14- 303(8)10] Stream buffers. Show all stream buffers on the property.

12. [14- 303(A)] Statement of consent to division. Revise the TMP reference in the consent statement. Provide
consent statements for both parcels impacted by proposed easements.

13. [14- 303(H &I)] Monuments, Bearing and distance ties. Provide the location and material of all permanent
reference monuments. At a minimum, a definite bearing and distance tie between not less than two
permanent reference monuments must be provided. It appears only one monument is noted on the plat.

14. [14- 303(L)] Public utility, drainage and sight distance easements. Provide a Deed of Easement for all
drainage easements for review and approval by the County Attorney's Office. This deed must be recorded
with the plat.

Rev2: Comment not fully addressed. The easements have been revised to be private, so no deed is
required. However, revise easement note 6 to say the easement is `conveyed', not dedicated, to the
Old Trail Community Association.
15. [14- 303(M)] Street names. See E911 comments for information regarding proposed street names.

16. [14- 303(0& P)] Signature and Notary panels. Add a signature line and notary panel for the owner(s) of the
two parcels impacted by proposed easements.

17. [14 -311] Infrastructure improvement plans, computations and documents. All Road Plan and WPO related
improvements for Phase IIIC must be built or bonded prior to approval of this plat.

18. [14 -317] Instrument evidencing maintenance. A maintenance agreement for the proposed landscape and
sidewalk easements shall be submitted for review and approval; as with previous phases, a supplemental
declaration should be sufficient. This supplemental declaration must be recorded with the plat.

Rev2: Comment not fully addressed. The declaration has been reviewed by the County Attorney's
Office and their comments have been provided. Keep in mind that the last revision date on the plat,
once it is deemed approvable, is what is required in the declaration.
19. [Comment] This plat cannot be approved until VDOT, ACSA and Engineering complete their reviews and
grant their approval. Inspections and Fire /rescue have reviewed the plat and have no objections. E911
comments have been provided.

20. [Comment] This plat cannot be approved until all bonds for this phase have been posted. Additionally, the
Deed of Dedication, Deed of Greenway Easement and Deed of Drainage Easement must each be reviewed
by the County Attorney's Office. Once the plat is approvable, the Deeds must be modified with the latest
revision date and resubmitted for County Executive signature. The supplemental declaration must also be
reviewed by the County Attorney's Office, but no County signature is required. The approved plat cannot be
released until all associated documents are approved and signed.
Rev1: Comment still valid. The Deed of Greenway Easement is not required. A Deed of Vacation
must also be submitted.
Rev2: Comment still valid. County Attorney comments on all submitted documents have been
provided. The supplemental declaration and Deed of Dedication have been conditionally approved
provided the final revision date of the plat is added once the plat is deemed approvable. The Deed
of Dedication must be submitted for final approval and County Executive signature prior to plat
signature.
