[14- 302(A)(9)] Building site on proposed lots. The plat shall contain the following note: "Parcel X and the residue of Tax Map /Parcel 80 -183 each contain a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance." Provide this note. 2. [14- 302(A)(10)] Right of further division. Revise the development rights note as follows, "Parcel X is assigned 1 development right and may not be further divided. Parcel Y (the residue of Tax Map /Parcel 80- 183) is retaining 4 development rights and may be further divided. 3. [14- 302(8)(1)] General information. When revised, please include the revision date on the plat. 4. [14- 302(8)(5)] Zoning classification. Add Entrance Corridor (EC) to the Zoning information. 5. [14- 302(8)(7)] Reservoir watershed /agricultural- forestal district. Provide a note stating that the parcel is not located in an agricultural - forestal district. 6. [14- 302(8)(8] Yards. Provide a note listing the required yards. In the Rural Areas, the yards are as follows: Front — 75' on existing public roads or 25' on internal public or private roads, Side — 25', Rear — 35'. 7. [14- 302(8)(10)] Stream buffers. The location of the stream buffer appears to be shown incorrectly along the western boundary of the parent parcel; GIS does not show the buffer extending all the way to Route 22. Show the stream buffer as represented on County GIS. Please also add the following note, "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance ". 8. [14- 303(0)] Signature panels. The spelling of the owner's name in the signature panel does not match that provided in County Real Estate records. Verify and provide the correct spelling of the owner's name. 9. [14 -312] Location of existing buildings. Show the location of any existing buildings within 50' of the proposed lot line. The location(s) must be shown on the plat to verify that setbacks are being satisfied. Additionally, if the parcel contained two dwellings prior to October 14, 2009 and each parcel created will contain one of the exiting dwellings, this subdivision will be exempt from some requirements of the subdivision ordinance. 10. [14 -316] Approval of entrance onto public streets. This requirement does not apply to subdivisions where two dwellings existed on the parcel prior to October 14, 2009 and the application proposes to put one existing house on each proposed parcel; however, the location of the existing houses must be verified on the plat prior to formal exemption from this requirement. 11. [Comment] The "20' Access Easement" shown on the plat appears to serve Parcel X, since it is located on the residue and covers the portion of driveway serving Parcel X that will be located on Parcel Y. The note stating "Total Easement Length = 150' for Parcel Y" seems to be trying to note the 150' of frontage required on an internal public or private street in RA. However, an easement is not a public or private street and does not provide frontage. As noted above, if this application proposes one existing house on each proposed parcel, street frontage and lot access requirements do not apply to the subdivision; therefore no private street would need to be created. If you do not intend to create a private street, please remove the note referencing the 150' as it creates confusion about what is being proposed. 12. Comment] The note stating the 20' access easement provides reasonable access by motor vehicle as required by section 18 -36 of the Subdivision Ordinance does not reference a section of Code that currently exists; this looks like perhaps it is a relic from an older 'family division' version of this plat? Please remove this note from the plat. Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which may be found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14- 229(6) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
