The development rights note seems to indicate that the original parcel has 10 development rights, when it only has 5. Revise the note to allocate the 5 development rights between the two resulting parcels. It appears that "New Lot 1" has two dwelling units on it (according to County Real Estate records), so it will need one development right with a minimum 2 acre area and an additional 21 acre area(23 acres total), or at least 2 development rights. If this proposed 21 acre parcel is assigned two development rights, that leaves only 10 acres for the remaining three development rights (31 acres total for all development rights). There are many ways the development rights can be allocated between the two parcels, but the note should read something like, "New Lot 1 is assigned X development right(s) and may be further divided and when further divided these rights shall not comprise more than Y acres. The residue of Tax Map /Parcel 54 -26 retains 5 -X development rights and may (or may not) be further divided, and when further divided these rights shall not comprise more than 31 -Y acres." Rev1: Comment not fully addressed. The new development rights note should be revised to say that the three developments rights retained by the residue shall not comprise more than 10 acres total, not 10 acres each. Rev2: Comment not fully addressed. The revised development rights note now says the residue shall not comprise more than 10 acres total; the 10 acre restriction refers to the development rights, not the residue. Please revise the note to say, "The residue of TMP 54 -26 retains 3 development rights and may be further divided, and when further divided these rights shall not comprise more than 10 acres total." 2. [14- 302(A)(11)] Instrument creating property proposed for subdivision. Revise the Deed Book and Page reference in the Statement of Title to DB 4520 Page 531, instead of Page 2014. Rev1: Comment addressed. 3. [14- 302(8)(1)] General information. Correct the scale; the title block lists 300 scale while the graphic scale is labeled 200. Rev1: Comment addressed. 4. [14- 302(8)(5)] Zoning classification. Add Flood Hazard Overlay (FH) to the zoning note. Rev1: Comment addressed. 5. [14- 302(8)(7)] Reservoir watershed. Revise the watershed note to indicate that the property is within the South Fork Rivanna Water Supply Watershed. Rev1: Comment addressed. 6. [14- 302(B)(10)] Stream buffers. Show the location of all streams buffers present on the property, and add the following note: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle County Water Protection Ordinance." Rev1: Comment addressed. 7. [14 -309 & 14 -310] Soil evaluations & Health director approval of septic systems. Health Department approval of a primary and reserve drainfield for each parcel is required. Soils evaluations must be submitted to Community Development, and will then be forwarded to the Health Department for their review and approval. This plat cannot be approved until their approval is granted. Rev1: Comment not addressed. Documentation must be provide that shows that the approved primary and reserve drainfields serving the existing houses are within the boundaries of New Lot 1. Additionally, a primary and reserve drainfield must be approved for the residue of TMP 54 -26. Rev2: Comment addressed. 8. [14 -316] Approval of entrance onto public streets. Please provide VDOT approval of the proposed entrance for each parcel; contact information can be provided if needed. Rev1: Comment addressed.
