McElwain Parker, McElwain & Jacobs, PC 2340 Commonwealth Drive Charlottesville, VA 22901 Re: Reversal of Notice of Determination dated January 30, 2009 (VIO 2009 -20) and AP 2009 -003 Dear Mr. McElwain: In our further review of this. issue, I am hereby reversing the previously issued determination of zoning violation (VIO 2009 -20) dated January 30th. -By reversing the determination, it will render the appeal moot:. We.will process a refund for the' application fee and.this appeal (AP 2009- 003):will- not be scheduled for a public hearing. We do appreciate the justification that you provided in your appeal.. With that information and our observations, we reviewed the applicable Zoning Ordinance language. We came to the same conclusion that you did in your justification. These two trucks are not prohibited advertising vehicles. In order to make this a new official determination, this letter will include the standard appeal language. If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of the date notice of this determination is given, in accordance with Section 15.2 -2311 of the Code of Virginia. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal shall be taken only by filing with the Zoning Administrator and the Board of Zoning Appeals a notice of appeal which specifies. the grounds for the appeal. An appeal application must be completed and filed along with the fee of $120. The date notice of this determination was given is the same as the date of this letter. Sincerely, Amelia G. McCulley, P.
