Dear Alan,
Staff has reviewed your revised submittal (1" set of revisions) for your request for a special use permit for
outdoor storage of equipment in the Entrance Corridor Overlay District. This letter lists reviewers'
comments on that plan and outlines the next steps in the process. We would be glad to meet with you to
discuss our comments and next steps, if you wish.
Planning
Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below.
Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and Board
of Supervisors as part of the staff report.
The Comprehensive Plan shows this area as industrial service in Neighborhood 4. This designation
includes warehousing, light and heavy industry, research, office uses, regional scale research, limited
production and marketing activities, and supporting commercial uses. The proposed use is similar in
type and scale to the designated uses. The Comprehensive Plan (Chapter 2, Natural Resources and
Cultural Assets) establishes the goals for preserving the scenic resources that are essential to the
County's character, economic vitality and quality of life. The Entrance Corridor Overlay District is
intended to support that goal by maintaining the visual integrity of the County's roadways. The
Architectural Review Board addresses potential adverse aesthetic impacts in the Entrance Corridors
by applying the County's Entrance Corridor Design Guidelines during their review of development
proposals. The ARB's comments are provided below.
Zoning
The following comments from the Zoning Division have been provided by Rebecca Ragsdale.
1. Parking space requirements appear to be addressed on the plan although parking note on the cover
sheet should be revised 13 required spaces for employees. If they are coming to the site to get work
equipment and leaving their vehicles then that is "assigned to work at the site ".
2. Contractor's (construction office, shop, equipment storage and materials yard): One (1) space per
employee assigned to work on -site plus one (1) space per facility vehicle.
3. Delineation of parking spaces. Parking spaces shall be delineated in a manner that identifies and
preserves the required dimensions by paint striping, signage, or by another means approved by the
zoning administrator. The zoning administrator may authorize that bumper blocks or posts be used to
delineate parking spaces on surfaces that are not conducive to paint striping. The wheel stops shown
are adequate to meet this requirement as long as the County Engineer grants the 4.12.15 waivers.
4. Requirements of 5.1.52 apply, but if alternative designs are proposed that better achieve screening
and meet ARB requirements, a waiver /modification should be processed with SP 2014 -19. The
request for a waiver only addresses screening from Avon St. but the ordinance section is applicable
to other property lines as well including the rear property line adjacent to Willoughby.
Please note that Zoning comments # 1, 2 and 3 are issues that can be addressed with the final site plan. The
special exception referenced in comment #4 will be addressed with the Special Use Permit request. As
discussed at the March 16, 2015 ARB meeting, staffs recommendation is for landscape screening on the
sides of the storage area and along the EC front, and a fence for screening along the back of the storage area.
Current Development
Christopher Perez in Current Development has provided the following comment on screening requirements.
[32.7.9.7(a)l] Screening. Commercial and industrial uses shall be screened from residential uses
when deemed necessary by the agent... The proposed use abuts a residential use, specifically open
space associated with Willoughby subdivision, beyond the open space area are homes associated
with Willoughby. The Agent has considered the proposed use from the Willoughby vantage point
and has determined it to be highly visible during the winter months due to the lack of vegetation at
the rear of the site and the type of vegetation (deciduous trees) on the Willoughby properties. The
Agent has determined that screening shall be required /provided along the rear of the property
pursuant to section 32.7.9.7. Based on the topography of the site and the height of the proposed
vehicles being stored staff recommends a twelve (12) foot tall wooden fence for screening in place of
the guard rail at the rear of the property. The area of the building does not need to have a fence as the
building provides adequate screening. As you know there is a Special Exception request under
review by the County to modify the requirements of Section 5.1.52, if the Board of Supervisors
approves the Special Exception for the back portion of the parcel, the agent will not require the
screening of the back portion of the parcel under Section 32.7.9.7,
Engineering and Water Resources
The following comments related to engineering and water resources have been provided by Max Greene.
1. County Engineer is not inclined to approve a waiver for gravel for commercial parking areas. [18-
4.12.15.a]
2. County Engineer requests curb be extended to the Stormwater facility. [18- 4.12.15.g]
3. SWM facility needs a pre- treatment due to potential contaminants from stored vehicles and the
steepness of slope and lack of sheet flow to stream.
4. Parking spaces should be protected with a minimum 3' wide island [18- 4.12.15.f]
5. Entrance slope appears to exceed 10% on the inside of the exit lane. Proposed contours will need to
be moved around to meet the 10% requirement. [I 8-4.12.17.a]
Note that these comments are issues to be addressed with the final site plan.
Building Official
The following comments are provided by Jay Schlothauer. the Building Official.
No objection.
Entrance Corridor
On March 16, 2015, the ARB voted unanimously to forward the following recommendation to the Planning
Commission.
The ARB has no objection to the request for the Special Use Permit with the following conditions:
1. Equipment shall be stored only in areas indicated for storage on the site plan entitled: Virginia
Asphalt Services Landscape /Screening plan, revised 2 -17- 2014(2015).
2. The site shall be landscaped in general accord with the plan entitled Virginia Asphalt Services
Landscape /Screening plan, dated 2 -17 -2014 (2015), except that:
a. Evergreen screening tree height shall be 8' - 10' minimum at planting,
b. The scarlet oaks shall be 3'/2" caliper minimum at planting,
c. The sugar maples along the entrance drive shall be 2'/z" caliper minimum at planting,
d. A staggered row of evergreens 8 -10' minimum tall shall be provided along the south side of the
storage area.
e. A staggered row of evergreens 8 -10' minimum tall shall be provided along the north and west
side of the entrance drive /asphalt paved area.
f. Any screening fence required on site requires ARB approval. Chain link fence and chain link
with vinyl slats shall not be approved.
3. Maximum height of equipment shall not exceed 12'.
4. Equipment shall not be elevated.
5. No new chain link, barbed wire, razor wire or other similar fencing or attachments shall be added to
this site.
VDOT
The following comment has been provided by Troy Austin for VDOT.
Generally VDOT does not have objections to the proposed special use permit or waiver request for
this project provided that comments on the initial site plan are adequately addressed.
ACSA
The following comments from ACSA have been provided by Alexander Morrison.
I have reviewed the SP and have no comments.
RWSA
The following comments from RWSA have been provided by Victoria Fort.
RWSA has reviewed the abovementioned applications and does not anticipate any conflicts with
RWSA utilities associated with the proposed site development. As such, RWSA does not have any
comments for the applicant.
Fire/Rescue
The following comments from Fire /Rescue have been provided by Robbie Gilmer.
No comments or objections.
Health Department
The following comments from the Health Department have been provided by Josh Kirtley.
The septic permit has been approved for this site, so we're good to go there. The applicant had to
abandon an existing well on the property before the approval could be given, so that was a bit of a
hang up. Nonetheless, everything looks to be squared away on our end.
SP Conditions
At this point in the review process, we anticipate that recommended conditions of approval for the Special
Use Permit will include those conditions recommended by the Architectural Review Board for landscape
screening along Avon Street Extended, and conditions related to other on -site landscaping, the location of
equipment storage, and the height of equipment to be stored.
Other conditions are anticipated regarding the screening of the equipment storage area resulting from the
supplemental regulations for screening in industrial areas and the related request for the special exception.
These conditions are separate from the SP request, but will be addressed in the SP staff report.
Action after Receipt of Comments
After you have read this letter, please take one of the actions identified on "Action After Receipt of
Comment Letter" which is attached.
Resubmittal
If you choose to resubmit, please use the attached form. An additional fee will be charged for the next and
all future resubmittals. The resubmittal date schedule is provided for your convenience.
Notification and Advertisement Fees
Recently, the Board of Supervisors amended the zoning ordinance to require that applicants pay for the
notification costs for public hearings. Prior to scheduling a public hearing with the Planning Commission,
payment of the following fees is needed:
$140.50 Cost for newspaper advertisement
200.00 Cost for notification of adjoining owners (minimum $200 + actual postage /$1 per owner after 50
adjoining owners)
$ 340.50 Total amount due prior to Planning Commission public hearing
Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the Board
hearing needed.
$ 140.50 Additional amount due prior to Board of Supervisors public hearing
$ 481.00 Total amount for all notifications Fees may be paid in advance. Payment for both the Planning
Commission and Board of Supervisors public hearings may be paid at the same time.
Additional notification fees will not be required unless a deferral of the Special Use Permit takes place and
adjoining owners need to be notified of a new date.

Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. The full resubmittal schedule may
be found at www.albemarle.org in the "forms" section at the Community Development page. Be
sure to include the resubmittal form on the last page of your comment letter with your submittal.
The application fee which you paid covers staff review of the initial submittal and one resubmittal.
Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request an
indefinite deferral. Please provide a written request and state your justification for requesting the
deferral. (Indefinite deferral means that you intend to resubmit /request a public hearing be set
with the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time, you may schedule a public hearing with the Planning Commission. However, we do
not advise that you go directly to public hearing if staff has identified issues in need of resolution
that can be addressed with a resubmittal.
After outstanding issues have been resolved and /or when you are ready to request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with the
Planning Commission's published schedule and as mutually agreed by you and the County. The
staff report and recommendation will be based on the latest information provided by you with
your initial submittal or resubmittal. Please remember that all resubmittals must be made on or
before a resubmittal date.
By no later than twenty -one (21) days before the Planning Commission's public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See attached
Fee Schedule) Your comment letter will contain the actual fees you need to pay. Payment for an
additional newspaper advertisement is also required twenty -two (22) days prior to the Board of
Supervisors public hearing. These dates are provided on the attached Legal Ad Payments for
Public Hearings form.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The only
exception to this rule will be extraordinary circumstances, such as a major change in the project
proposal by the applicant or more issues identified by staff that have not previously been brought
to the applicant's attention. As always, an applicant may request deferral at the Planning
Commission meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule your
application for a public hearing based on the information provided with your original submittal or
the latest submittal staff received on a resubmittal date.

Fees may be paid in cash or by check and must be paid at the Community Development Intake
Counter. Make checks payable to the County of Albemarle. Do not send checks directly to the
Review Coordinator.

The reviewing planner will contact applicant to discuss comments of reviewers and advise that changes that are needed are significant
enough to warrant an additional submittal or advise that the the project is ready for a public hearing. If changes needed are minor, the
planner will advise that the project go to public hearing.
" The legal ad deadline is the last date at which an applicant can decide whether to resubmit or go to public hearing. If an applicant
