Therefore, we must assume that RWSA was not included in the amendment for a reason. To amend the ordinance now would be more than a matter of simply adding RWSA as a quick housekeeping "fix." John Shepherd Manager of Zoning Administration (434) 296 -5832 ext. 3023 From: John Shepherd Sent: Monday, March 23, 2009 11:00 AM To: Philip Custer Cc: Glenn Brooks Subject: RE: Review of the Moore's Creek Sanitary Sewer Interceptor Phil, I have reviewed the ordinance and discussed this with Ron and Amelia. We find that a project of RWSA does not qualify as the by -right use right use listed in section 30.3.05.1.1 (6). Rather, it requires a special permit under 30.3.05.2.1 (2) or 30.3.05.2.2 (1). 30.3.05.2.1 BY SPECIAL USE PERMIT WITHIN THE FLOODWAY The following uses or activities are authorized within the floodway by special use permit: 2. Water related uses such as boat docks, canoe liveries, bridges, ferries, culverts and rivercrossings of transmission lines of all types. 30.3.05.2.2 BY SPECIAL USE PERMIT WITHIN THE FLOODWAY FRINGE 1.
