Hi Frank,
Ron and I have talked with Wayne and Amelia and here are the preliminary comments we can make to answer your
questions, below:
Question: If the site layout did not change from that shown on the proffered plan, but the unit type went from townhouses
to single - family detached, would it require a zoning change.
Answer: No, it wouldn't; however, you would need to be aware of the platting requirements for single family detached
structures, meet all setback requirements, and get approval for a private street. This could affect how many units you
could actually get in the space allotted. There may be other limitations -- these are the ones that come to mind.
Question: If we wanted to submit a rezoning to rearrange the density, not add new units, would we be subject to cash
proffers?
Answer: The County's cash proffer policy (attached) indicates that you would not be subject to cash proffers -- here is
the paragraph:
c. No increase or small increase in density: In rezoning applications where there is a minimal increase in density, a credit
may be given for the number of residential units allowed under the existing zoning and the cash proffer amount will be
based only on the estimated density increase resulting from the rezoning. This credit may be allowed only for those
rezoning applications where the rezoning seeks the design flexibility allowed by the Neighborhood Model zoning district or
seeks to amend a prior rezoning with no increase in density. The credit should not be allowed if the rezoning application
seeks to increase density in a conventional, rather than a planned, zoning district.
