To Whom It May Concern:
In accordance with the proffers approved with rezoning ZMA 2004-7, Albemarle County
requests the owner to contribute $5000 for historical roadside markers as contained in proffer 6.3.
The proffer indicates that the request for these funds must be made within one year following the
date of approval for the first final site plan for Phase I. County records indicate that SDP 2008-22
was approved 4/16/08. For your convenience, a copy of the entire proffer is listed below.
6.3 Roadside Markers. Upon request by the County, the Owner shall contribute up to
.five thousand dollars ($5,000) cash to fund the cost of creating and installing two roadside
historical markers as described in. section 5 of the Code of Development. if the request is not
made within one (1) year froze the date ofapproval of the first 'final site plan:%rrPhase 1, this
proffer shall become null and void. If such cash contribution is not mpended for the stated

=expended funds shall be refunded to the Owner.
Kindly provide payments within 30 days. Please be advised that failure to comply with
approved proffers will constitute a zoning violation that may result in civil penalties enforced by the
Zoning Administrator in consultation with the County Attorney (See, Chapter 18, Sections 33.3.3,
37.2A13, Albemarle County Zoning Ordinance).
