HomeMy WebLinkAboutZTA200900006 Legacy Document 2009-04-24ZTA2009 -00006 18- 4.11.2 Restoration of front setback for accessory structures and establishment of minimum separation between accessory and primary structures Background In 1983 4.11.2.1 was amended to: • Increase accessory structure setback from 5' to 6'; and, • Prohibit location of accessory structures in front yards adjacent to streets or access easements in the RA or residential districts. In 2002 4.11.2.1 was amended again to: • Add provisions to allow accessory structures to be located 3' from alleys; and, • Delete the prohibition of location of accessory structures adjacent to streets and access easements. Proposed Revisions • 4.11.2 (a) restores prohibition of location of accessory structures, including detached garages in required front yards. • 4.11.2 (b) addresses side and rear setbacks for accessory structures and setbacks for these structures adjacent to alleys adjacent to alleys. • 4.11.3 adds a requirement that easement holders approve encroachments. Proposed Revisions • 4.11.2 (c) Includes retaining walls on the list of structures that are permitted in required yards. • 4.11.2 (d) has been drafted to require accessory structures located closer than 1' to the primary structure to meet the primary setback. Questions for the Commission • Is the 1' separation appropriate? • Should signs be eliminated from proposed 4.11.2 (c)? • Should ATMs be added to proposed 4.11.2 (c)? • Should dumpsters be added to proposed 4.11.2 (c)? Recommendation • Staff recommends approval of the Resolution of Intent and asks the Commission to advise if it recommends further revisions to the proposed ZTA and to set this matter for public hearing.
