This letter is based on a review of our records and an inspection of the site. 1. The referenced property is zoned Residential- R-10. 2. The property is in the Airport Protection Area Overlay District- AIA. 3. The parcels abutting the property are zoned Residential- R-10. 4. This is not a Planned Unit Development. 5. There are no legal nonconforming issues associated with this site. 6. The Board of Supervisors, on December 11, 1996 approved ZMA-96-20 as proffered and SP -96-42 with conditions. The rezoning replaced the prior proffers. The special permit allowed a 126 -bed assisted living facility. Copies of the action letters are enclosed. 7. This project was built in accord with a site development plan, SDP -97-67, that was approved on June 19, 1997. Two minor amendments have been approved since: SDP -97-108 on September 18, 1997 and SDP -98-127 on Ms. Brandi Trogdon February 27, 2009 Page 2 September 2, 1998. The plan shows an assisted living facility with 126 beds. In 2007, a Letter of Revision to SDP97-67 allowed the construction of a storage shed. 9. A Certificate of Occupancy was issued August 26, 1998 for the facility. In 2007, the storage shed was added and a Certificate of Occupancy was issued January 2, 2008. 10. A review of our records does not show any unresolved zoning complaints. It is our policy to conduct a site inspection for all zoning compliance requests. On February 25, 2009, it was observed that some landscaping was missing on the site. This is a violation of the site plan and must be corrected in order to avoid further enforcement proceedings.
