Dear Ms. Benaicha:
This letter is to confirm the following with respect to the Property owned by Wal-Mart
Real Estate Business Trust (Wal-Mart):
■ The Property is currently zoned Highway Commercial (HC);
■ The Property is subject to several Special Use Permits. Outdoor storage and
display is permitted by Special Use Permit. A copy of the action letter with
conditions is attached for each of these;
■ The Property is located in the Entrance Corridor Overlay District (EC) and
Airport Impact Area (AIA);
The zoning is appropriate for Wal -Mart's use of the property for 24 hour
operation retail, and accessory uses to include a pharmacy, medical clinic,
restaurant, optometrist, hair salon, tire and lube facility, grocery sales, bulk
sales and garden center. As stated above, the outdoor/seasonal sales use is
allowed by special use permit;
■ This office has no record of violations or alleged violations of zoning
regulations applicable to the Property. All prior violations have since been
abated;

■ No fees are due or pending with respect to any matter before the County of
Albemarle Department of Community Development.
■ A site plan application for a major amendment, SDP2009-28, is currently under
review to allow a 35,000 square foot expansion to the existing building.
