Hello Ches, I thought I would put in writing what you discussed with Ed before you left
for vacation. I tried to call you back on Friday but couldn't get in touch with you. As
per the letter that I sent along with our application for the program, we would like to
try and submit our application without the rental property with its 3.87 acres.
We realize that it may lower our points without that piece. If by lowering our points, it
puts us too low on the list to have our property included in the program, we would then
submit both properties together. The parcel number for that property is #
4000- 00- 00- 017A0. If you need any other information in order to calculate the points
taken away for that piece of property, please let me know. We are very excited about the
program this year and look forward to hearing from you. We would also like to know when
the Board of Supervisors would be meeting to accept the recommendations from the ACE
committee so we could attend that meeting. Thanks for

Sorry for any confusion.
What I meant was leaving the 3.87 acres out of the easement would not affect your
eligiblity status and it should not greatly affect your chance for getting funding because
I believe we have enough in our budget to purchase easements on 9 -10 properties. Since
removing the 3.87 acres would drop you from 7th to 9th place, this does put you in a
little more precarious position - in the event the properties appraise at substantially
higher values than I have estimated (as you said, the appraised values will ultimately
determine what we can actually afford). In the past, we have gone overbudget to buy
additional properties if the last few were grouped close together Like you are with Rock
Mills and Donnelly.
The biggest impact would be your loss in easement value - what we pay you. Based on the
2004 assessment of $86,700 (for land), an easement on the 3.87 acre tract is probably
worth $20,000- 25,000.
I am hoping to get approval (from the board) of our request to have the properties
appraised at the May 4th BOS meeting. Once we get approval, we will advertise the
appraisal work and hopefully have them completed by late this summer. My guess is the
actual closing and payment to you will be in 2006, not 2005.

Ches, Ed and I got your phone message the other day. We appreciate your refiguring our
property without the 3.87 acres. You said it wouldnt make much difference in whether our
land was assessed or not. I wasnt
quite sure what you meant by that. Does having the property assessed mean that you are
likely to be
accepted into the ACE program? You said in your letter that probably all 10 properties
would be accepted because of the extra money this year. Wouldnt the dollar amount that
the properties are assessed at, actually determine how many are accepted? Maybe I am
confusing myself. When will the list go to the Board of Supervisors?
Also, when is the money actually paid to the property owner? Is it in 2005 or 2006? Ed
and I are speaking with our tax person this week just to see what might happen taxwise.

Hi Ches, I was sorry to miss your phone calls. In looking over what you have written, I
wanted to correct one thing. On our 86.7 acre property, we have our primary single family
dwelling unit. We also have one workshop /shed which does have electricity in it, no
water. We also have a hay barn, with two open sides and two closed sides, no power or
water in it. Those are the only structures on the 86.7 acre piece. On the other
property,which we are not including in the easement, we have one residential building that
we rent out. I dont think that our shed /workshop should be called a secondary residential
dwelling. The only thingns that live there are mice. The section written on the forest
management is fine. We have no forest management plan on file. As far as I know, we have
no liens or defects on the title. If you need anything else from us at this time please

Subject: Draft provisions for Deed of Easement
Chris & Ed:
Below are the draft provisions for the Deed of Easement, which I wrote and called you
about the other day. They are pretty straightforward.
Rushia, Ed & Chris - TM 39, Parcel 27 ( 86.700 acre
#1) Section 2.A.1 ( "Division ") - The Property is currently comprised of one (1) parcel.
For all purposes of this Easement, the Property shall be considered to be one (1) parcel
and it shall not be divided or subdivided; the Property may be sold or conveyed only as a
whole; no parcel shall be separately sold or conveyed.
- Since your property is less than 100 acres (our cutoff for subdividing), this provision
can't be changed.
#2) Section 2.B.2 ( "Types of Structures ") - In addition to one existing principal single -
family dwelling unit and one secondary residential dwelling, no permanent or temporary
building or structure shall be built or maintained on the Property other than: (a) up to
one (1) additional secondary residential dwelling, commonly and appropriately incidental
to a principal single- family dwelling unit; (b) structures such as outbuildings, swimming
pools, decking detached from the single - family dwelling units, gazebos, garages, and tool
sheds; and (c) farm buildings or structures.
- Based on the amount of acreage you have, you are permitted 1 primary and 2 secondary
residential structures. Since it appears you already have 1 primary and 1 secondary, you
would be allowed 1 additional secondary dwelling.
#3) Section 2.C.2 ( "Forest Management ") - Forestal uses including, but not limited to,
reforestation, site preparation, timber harvesting and forest management activities
undertaken to produce wood products and /or improve the health and productivity of the
woodland. Management activities shall be based upon the best available technical advice
of a professional forester. During all harvesting activity, applicable Best Management
Practices, as established by responsible state agency, shall be used to control erosion
and protect water quality. The processing of wood products is not a forestal use, except
as an accessory use. The clearing of land for conversion to farmland or other agricultural
uses, however, may be permitted.
- I assume you would want a standard forest management provision like the above. If you
would like to change this, please let me know. Also, if you have a Forest Management Plan
on file that you have approved, I willmention this in the provision.
