Re: Appeal 2009 -004 for Tax Map 78, Parcel 58K
Dear Mr. Dettor:
I enjoyed meeting with you today. Thank you for your cooperation in constructively
working with the County towards resolving this violation. As you requested, I've
attached a copy of the withdrawal letter for your files. As a result of your withdrawal,
this case will not be heard by the Board of Zoning Appeals and you do not need to
attend their August 4t" meeting.
I appreciated having the information you obtained regarding how many people,
including relevant agencies, are not aware of these tree cutting regulations. I will make
it a point to work with the Department of Forestry on this in the near future.
I thought it would be helpful to go over a few things about final resolution of this zoning
violation with this letter. As you mentioned onsite, your plans for constructing a garage
may involve a relocation of the entrance for this property. You also talked about how a
change such as that may result in a change to your proposed planting plan. We will be
flexible and understand that you may need to revise the planting plan if that will occur.
Our focus on new tree plantings will be limited to the Route 20 frontage of this property.
As I also mentioned, because evergreen trees (trees that remain in green needles or
leaves all year round) were removed, we will want the replanting to primarily or entirely
of evergreen trees. We recognize that it's not possible to replant the same size trees
that were removed; however, we ask that the new trees be as large as can be
reasonably purchased and that will survive once planted. You will need to contact your
arborist to ask him to prepare a replanting plan to submit to us. He has the expertise to
know which species, sizes and spacing are best to allow the trees to thrive. Please
tH
submit a planting plan as soon as possible and no later than August 14

Once the plan is approved by us, we will expect the trees to be planted within the next
- growing season. Technically, it is only once the trees are planted that the violation is
fully abated. As you called the current season, "dog days" is not a good time for new
plantl ngS. i'our ar bvr ist can let

If you have any questions or concerns, please do not hesitate to contact me. Thanks
again for your cooperation.
