Hello Gentlemen,
I received these emails last Thursday. As of now it appears you have still not agreed to what is going to happen
with respect to condition #10 and the trees around the cemetery, and really I think its between you all to come
to an agreement and then inform me what it is going to be. The extent of planting that the Church describes below
and what Mr.Rintels describes in his letter (attached) are not the same.
I have laid out what the County's requirements are to meet the conditions of the SP and what your options are if
you decide to pursue a private agreement, and I am having a hard time continuing to review the plan without a
clear understanding of what both parties agree to. As of now there are two options:
1. Mr. Rintels provides an easment or license and the church is required to conform to the requirements of
condition #10, as it is written. This means trees along the entire perimeter of land the church and Rintels share
(not including the cemetery.) Mr. Rintels has until Aug. 7, 2009 to indicate to the County whether he is, or is not,
providing an easement or license.
2. Mr. Rintels does not provide an easement or license and anything the Church shows on the site plan I review
as landscaping that is above - and - beyond what is required. This second option does not require me to review that
the landscaping conforms to any private agreement you all make. However, in the spirit of trying to do what's best
for both parties, I am hereby asking for you all to work out an agreement and submit to me, in writing with an
indication of support by both parties, one document that outlines what both parties agree and intend to do in lieu
of condition #10 so that I may move forward with reviewing the plan if Mr. Rintels does not provide an easement
or license. I am not requiring you to provide this to me, however I want to be clear that if I do not get this
information, and I do not get in writing from Mr. Rintels that he is providing an easement or license, I will be forced
to review anything the Church shows as screening as voluntary and above - and - beyond what is required.
Both parties have indicated you believe an agreement is possible, so I encourage you all to get together and
actually come to an agreement on how you want to move forward with this project. The clock is ticking and I need
to know by August 7th, close of business, how you want to address the screening issue related to condition #10.

South Plains Presbyterian Church will at the county's direction plant the trees specified by the Board of

Supervisors along our property line with the Rintels, beginning at the SE corner of the cemetery and
continuing to the tree line at the SE corner of the church parcel. We would prefer to plant those trees on
our side of the boundary. I understand that Mr. Rintels has agreed to this.
I believe you know that the boundary between the cemetery and the Rintels already has an established
border of white pines 2 -5 feet tall. These will screen the cemetery within a few years. The cemetery
parcel has never been part of the Special Use Permit application.
