I also appreciate your willingness to plant additional Leyland cypress in a cooperative effort to comply with the special use permit condition. The purpose of this letter is to confirm the agreement for our files and to serve as a letter of revision for the site plan. The currently approved site plan shows continuous evergreen plantings on the north, east and west sides of the project-. The plantings along the east and west sides of the project are installed. In those areas, they constitute a continuous Leyland cypress "hedge." The approved site plan does not show a continuous Leyland cypress hedge along the north or rear of the property (along the railroad). In that area, it primarily shows leylands but also includes other evergreen trees. You have agreed to provide supplemental Leyland cypress plantings to better achieve the hedge and to meet the condition (listed below). 6. Screening along the west and east sides of the project shall be provided and maintained as depicted on the Conceptual Diagram of Perimeter Screen and Privacy Planting, dated May 12, 2005, by Charles J. Stick attached as Attachment B. The continuous evergreen trees noted as Leyland Cypress Hedge along the north, east, and west sides of the project shall be installed at ten feet to twelve feet in height after lot grading but prior to issuance of a building permit for any dwelling unit construction. The Leyland Cypress Hedge also shall be planted on eight foot centers. Underground irrigation shall be provided for all the planting areas. Screening deemed acceptable to the Director of Community Development shall be provided adjacent to the railroad to mitigate the impact of this development on adjacent property and the impact of the railroad on this development. Kenridge — S.P. 2004-52 April 15, 2009 Page 2 As we discussed and you agreed, due to the fairly significant elevation difference between the rear of the property (higher) and the property on the other side of the railroad (lower), the leylands will be most effective if planted as high as possible. In most of these areas, the presence of two retaining walls and the 20 foot public sewer easement constrains the available area for plantings. As confirmed by Pete Gorham of the ACSA, no plantings are permitted within the easement. However, they may be planted just outside the easement with the acceptance that some limbs may overhang the easement. This constitutes a letter of site plan revision to allow the plantings as agreed. There are a total of 3 tiers of retaining walls in the rear of the site adjacent to the railroad. The . lowest wall forms the side of the stormwater facility. The highest wall holds the grade for the rear yards of the units. Just below the highest wall is a second wall. The sewer line and easement are between the upper and middle walls. Leyland cypress will be a minimum of ten (10) to twelve (12) feet in height on eight foot centers. They will be in a single row at any point. They will be planted in the following areas: A few trees will be planted in the area between unit 11A and the stubbed out end of the driveway between units 11A and 16A. They will supplement existing. landscaping. Plant leylands behind units 18A, 19B and 20C on the lower side of the upper retaining wall. Due to the lack of area outside the sewer easement in the proximity of unit 210, the trees will be planted just above the middle retaining wall and then continue this line of trees around the curved top of this wall and behind the next building that is around the corner.
