September 10, 2009 Elizabeth Marotta Senior Planner Community Development 401 McIntire Road, North Wing Charlottesville, VA 22902 RE: Critical Slopes —Request for Waiver Abbington Crossing — Clubhouse Replacement Dear Ms. Marotta: As per Albemarle County Code, we hereby request a waiver of the prohibition of disturbing slopes of twenty -five (25) percent or greater (critical slopes) as related to the above - mentioned Abbington Crossing — Clubhouse Replacement project. I feel that this waiver is warranted as the project does not lie within the Rural Areas (RA), Monticello Historic District (MHD) or Village Residential (VR) zoning districts and the following circumstances exist: i. The critical slopes were created during the development of the property pursuant to a site plan previously approved by the county, LOR #2 dated May 18, 2005 (see attached) to the approved site plan SDP -340 Squire Hill. In addition, I feel that this waiver is reasonable and will not be detrimental to public health, safety or welfare, to the orderly development of the area or to adjacent properties; and is not contrary to sound engineering practices for the following reasons: a. There will be no rapid and /or large -scale movement of soil and rock as the proposed 3:1 and 4:1 slopes within this project are consistent with industry standards and are actually flatter than the existing slopes and will also have sod installed at the completion of grading operations in order to more quickly stabilize these areas. b. The construction of the Abbington Crossing Clubhouse Replacement actually creates more landscaped and grassed areas and less impervious, paved areas; therefore, stormwater run -off will actually be decreased as a result of this project. c. Although there are no natural and man -made bodies of water within 250' feet of the project site, the incorporation of a complete Virginia Erosion and Sedimentation Control Plan into the Site Plan for the project coupled with the experienced construction of such erosion control measures and the regular inspections by Albemarle County Erosion Control Inspection staff will effectively eliminate the transportation of any silt or sediment into any natural or man -made bodies or water. September 10, 2009 Page 2 of 2 d. I feel that the construction of the Abbington Crossing Clubhouse Replacement will be a significant improvement to the aesthetic resources of the immediate area. Experienced, licensed individuals have designed all the architectural, landscape and civil design features, which are being implemented as part of a complete and comprehensive package.
