Pantops Dr. Charlottesville VA, 22911 RE: Tax Map 3261-05, Parcels 1 thru 16, 27 thru 42 (the "Property") Dear Mr. Lancaster: In response to your request concerning the above referenced parcels compliance with applicable codes, regulations and ordinances, please be advised as follows: ■ The Property is zoned Planned Development -Mixed Commercial (PD -MC) by ZMA-2001-20, approved August 6, 2003 and is subject to proffers. A copy of the action letter and proffers is attached. A variation was later approved to allow changes to the application plan as described below. ■ The Property is subject to conditions of the special use permit, SP -2003-30, which allowed the residential uses in the PD -MC zoning district. A copy of the board action letter with conditions is attached. ■ The site is currently under development. The final site plan, SDP2005-95, was approved November 15, 2006 to allow 42 single family attached residential units. An amendment, SDP -2008-182, allowed changes to .the building arrangement and to provide surface parking in place of single car garages for 16 of the units. ■ The units are currently under construction but are permitted in the PD -MC zoning district. The Property is in compliance with Section 25A.2.2(1) of the zoning ordinance. A copy of that section is attached.
