Witnessed: (� •Grantor"); and AUTO, LLC, (the - Grantee');
WHEREAS, Grantee or its assigns will develop certain property in Albemarle
County, Virginia, more particularly described as Albemarle County Tax Map 45, Parcels
100,101 MOM and
WHEREAS, Grantee will be carrying on certain construction on the above -
described properties; and
WHEREAS, during the term of said grading it may be n or
its agents to enter upon certain adjacent property described as Tax Map 45 Pan�I 105
owned by Grantor
And;
. WHEREAS, Grantor has agreed to allow Grantee or its agents a temporary
grading easement upon certain property of Grantor more
during this period of grading; And particularly described herein
WHEREAS, Grantor has agreed to allow the removal of
vegetation
side of the property of Grantor to provide for a grading easement. at the West
NOW THEREFORE, in consideration of Ten Dollars ($10.00) cash in hand Id
and other valuable consideration, the receipt of which Is acknowledged, Grantor does
hereby grant and covey unto Grantee, its successors and assigns, the following
described easement, to -wit:
The temporary easement area includes: 20 feet on the side of the Grantor along
the boundary line between the two properties described as Tax Map 45, Parcel 105 and
Tax Map 45, Parcel 101.
This easement begins at such time as a certificate of Insurance Is provided to
Grantor. Such certificate Is to state that the Grantor is an `additional Insured' on the
liability insurance policy for any contractor exercising
easement ceases at such time as the grading has been competed consistent This
the
Site Plan covering the site development and a soil erosion bond satisfactory to
Albemarle County is released or December 31, 2008 which ever should occur last.
Grantee agrees to protect and/or restore any improvements located within or
adjacent to this easement and to repair or pay for any actual damages which may be
done to these improvements or other structures directly caused by Grantee or Its agents
In the exercise of any rights granted herein.
