RE: SUB - 2008 -240- Little Yellow Mountain - Preliminary Subdivision Plat
Mr. Cummings:
The Board of Supervisors approved the above - referenced subdivision plat at its April 1st meeting.
The approval of the preliminary subdivision plat is valid for (5) five years in accordance with Section 14 -228
of Chapter 14 of the Albemarle County Code, provided that the subdivider submits a final plat for all or a
portion of the property within (1) one year of the approval as provided in section 14 -221, and thereafter
diligently pursues approval of the final plat. Therefore, the preliminary approval shall expire on April 1,
2010. If the preliminary plat approval expires, a new application must be filed and processed.
Please address all of the requirements and conditions listed below and submit eight (8) tentative plan copies to
the Department of Community Development. This letter must be submitted with the tentative plans, as a
checklist, to document that you have addressed all requirements or conditions, or the tentative plan will be
denied.
The Erosion and Sediment Control Plan and the BMP Stormwater Management Plan, with the associated
applications and fees, may also be submitted with the eight (8) tentative Plans. Failure to do so will result in a
separate application to be filed with the Department of Community Development at a later date.
Once the tentative plan is submitted and reviewed you will receive comments from all
departments /divisions /agencies that have made comment on the tentative plan. Any further responses
must be made directly to each department/division /agency that has further comment. After all
aforementioned departments /divisions /agencies have granted a tentative approval, you must verify with
the Planner that you may submit the final mylars. Signing of the plans will occur within one week once
it is determined that the final mylars reflect all tentative approvals.
The final plat will be subject to all final plat requirements (Subdivision Ordinance Section 14 -206), in
addition to the following conditions.
The Zoning & Current Development Division shall not accept submittal of the final plat for signature until
tentative approvals for the following conditions have been obtained:
Zoning & Current Development approval to include:
❑ The plat shall be subject to the requirements of Section 14 -303 (Contents of final
plat), as identified on the "Final Subdivision Checklist" which is available from the
Department of Planning and Community Development;
❑ The final plat shall address all minimum requirements from Sections 14 -410
(Standards for all street and alleys) and 14 -412 (Standards for private streets only);
❑ Health Director approval of individual private wells and septic systems;
❑ A maintenance agreement must be submitted and approved by the County Attorney,
as specified in Section 14 -317 of the Subdivision Ordinance;
❑ Not more than one (1) dwelling unit may be established on Parcel A and not more
than one dwelling unit may be established on TMP 55 -44 (Revised), as the term
"dwelling unit" is defined in the Albemarle County Zoning;
❑ Neither Parcel A not TMP 55 -44 (Revised) shall be further divided; and
❑ Conditions 5 and 6 shall be stated in the notes on the final plat.
