Dear Ladies and Gentlemen:
This letter is to notify you as adjoining property owners to property owned by T.E. Wood that
Mahmood Pashazadeh (appellant) has submitted an appeal application. The request is as
follows:
Appellant appeals the Zoning Administrator's determination of violation (Section
13.2) relating to the use of 2891 Seminole Trail as a rug store. The determination
is that this is not a permitted use in the R1, Residential district and it is not a
nonconforming use. The appellant contends that this use should be permitted
because it is less dangerous to the public than previous uses of the property.
This site is further identified as Tax Map 46, Parcel 28A1 and is zoned Residential
(R -1) District, Airport Impact (AI) Area, and Entrance Corridor (EC) Overlay.
The Board of Zoning Appeals will hold a public hearing on Tuesday, November 10, 2009, at
2:00 p.m., in the Auditorium, Second Floor, County Office Building, 401 McIntire Road,
Charlottesville, Virginia.
This application is available for your review in the Albemarle County Community Development
Department, First Floor, 401 McIntire Road, Charlottesville, Virginia.
