The applicant is proposing to pipe the drainage and fill in the area to make a flat field with a 2.5 or 3:1 slope at the edge. Areas Arees Total site _ 6.646 acres approximately Critical slopes 1.3 19.5% of site Critical slopes disturbed 0.32 24.8% of critical slopes Exemptions to critical slopes waivers for driveways, roads and utilities without reasonable alternative locations: Driveways, roads are not proposed within the critical slopes. Utilities do not have an alternate location outside of the critical slopes and are exempt. Compliance with Zoning Ordinance 18 -4.2: ,'movement of soil and rock" Proper slope construction, control of drainage, and vegetative stabilization will prevent any movement of soil. "excessive stormwater runoff" Stormwater runoff will be reduced in this area, as the slopes will be eliminated and stormwater controlled and directed into a stormwater maintenance facility. "siltation" inspection and bonding by the County will ensure siltation control during construction. Proper stabilization and maintenance will ensure long term stability. "loss of aesthetic resource" This area is visible from the rear of several houses in the neighborhood. A tree preservation area is proposed below the retaining walls in the rear of the site and the vegetation should buffer the view of the buildings as well as the retaining walls. "septic effluent" This neighborhood is serviced by public sewer. Based on the review above, there are no engineering concerns which prohibit the disturbance of the critical slopes as shown. Review of the request by Current Development Planning staff: Summary of review of modification of Section 4.2: Section 4.2.5 establishes the review process and criteria for granting a waiver of Section 4.2.3. The preceding comments by staff address the provisions of Section 4.2.5(a). Staff has included the provisions of Section 4.2.5.3 here, along with staff comment on the various provisions. The commission may modify or waive any requirement of section 4.2 in a particular case upon finding that: A. Strict application of the requirements of section 4.2 would not forward the purposes of this chapter or otherwise serve the public health, safety or welfare The property is an existing developed parcel and the project proposes to disturb approximately 0.32 acres of the existing critical slopes. Strict application of the requirements of section 4.2 would not forward the purposes of this chapter. B. Alternatives proposed by the developer or subdivider would satisfy the intent and purposes of section 4.2 to at least an equivalent degree; The applicant has proposed protective and restorative measures intended to minimize erosion and siltation both during and post construction. These measures will satisfy the purpose of Section 4.2. Transit Reservation .Area. Off -Site Improvements. The Owner shall provide stormwater management within the area depicted on the !Application Plan which may also be used as a shared storrnwater management and Best Management Practices (BMP) facility to serve both Treesdale Park and the development of Tax Map 61 -54. No final site plan shall be approved until all easements necessary for the off-site improvements shown on the Application Plan have been recorded. These off -site improvements include grading, stormwater management, construction of an accessway to the storniwater rnanaoemcnt facility and transportation improvements to the intersection of Rio Road and Pen Park Lane. 7. EarthCraft Standards for Multifamily Development. The Owner shall cause all multifamily buildings within the Project to be designed and constructed so as to be rated a minimum of "Certified" under the EarthCraft Green Building Ratinc, Systern for multifamily development, as set forth in the EarthCraft House Technical Guidelines. version November, 2006.
