'WIT NESSETH: WHEREAS, March Mountain is the owner of Block 1 of Old Trail Village Center ( "Block I") which property is more particularly shown on that certain subdivision plat entitled "Old Trail Village Center Block 1" dated May 7, 2008, prepared by Jennings Stephenson, P.C., which plat is of record in the Clerk's Office of the Circuit Court of Albemarle County, Virginia in Deed Book 3596, page 444; WHEREAS, March Mountain is the owner of Lot .2, Block 2 of Old Trail Village Center ( "Block 2, Lot 2 ") which property is more particularly shown on that certain subdivision plat entitled "Corrected Plat of Old Trail Village Center Lot 1— Block 2" dated September 14, 2009, prepared by Jennings Stephenson, P.0 which plat is of record in the Clerk's Office of the Circuit Court of Albemarle County, Virginia immediately preceding this instrument (the "Corrected Subdivision Plat "). f� WHEREAS, Piedmont Senior Living is the owner of Corrected Lot 1, Block 2 of Old Trail Village Center ( "Block 2, Lot 1 ") which property is more particularly shown on the Corrected Subdivision Plat; and WHEREAS, March Mountain and Piedmont Senior Living wish to establish a cross parking easement over and across their respective parcels pursuant to Albemarle County Code Section 18- 4.12.8 (e). NOW THEREFORE, for and in consideration of the sum of TEN DOLLARS ($10.00), cash in hand paid and other good and valuable consideration, March Mountain and Piedmont Senior Living do hereby grant and convey to each other, as Grantee, and to their respective agents, customers, invitees, licensees, tenants and employees, in common with others entitled to use the same, a non - exclusive easement for the passage and parking of vehicles over and across the parking, driveway and roadway areas of Block 1, and Lots 1 and 2 of Block 2, as the same may be from time to time be constructed and maintained for such use and for the passage and accommodation of pedestrians over and across the parking, driveway, roadway and sidewalk areas of Block 1 and Lots 1 and 2 of Block 2, as the same may be from time to time constructed and maintained for such use. The easement established herein shall be appurtenant to and for the benefit of Block 1 and Lots 1 and 2 of Block 2.
