Thanks for handling this with me. As you can see below the entrance for the church is proposed to be moved. This will impact the 20 foot buffer (no disturbance zone) on the north side of the property. The exact condition language from SP 2006 -24 is "A twenty (20) foot buffer (no disturbance zone) shall be maintained continuous along the boundary between the church property and TMP 31 -23J to the north" The church will have to obtain easements from the property owner of TMP 31 -23J. As the buffer is intended to protect this property owner it would seem that if the owner is granting permission for the grading to occur that preservation of the buffer is no longer needed. Further, it appears that the disturbance of the buffer is needed to obtain an entrance adequate to serve the church which was approved by the Board of Supervisors. Based on our conversation the buffer can be disturbed to install the necessary entrance improvements required by VDOT. This disturbance is permitted because: - The disturbance is needed to obtain access to the site which has been approved for use as a church. - The buffer was intended to protect the abutting owner. In this case the abutting owner will be granting permission for grading necessary to install the entrance. Therefore, the abutting owner can insure adequate protective measures when negotiating for the granting of easements. (i.e. the abutting owner can require plantings or other treatments should they believe them to be necessary. Any agreements would be between the two parties and not the County.) If you agree with this summary please let me know and I will pass it along to the applicant and the reviewing staff. Thansk William D. Mr. Shelton has met on the site with VDOT representatives and a couple of changes must be made to the site plan. Because obtaining sight distance at the location shown on the plan borders on impossible, VDOT suggested that the entrance move as far to the west on the site as possible. To move the entrance means that it is very possible that the 20' undisturbed buffer near the road will be disturbed. Is this disturbance, because it is a means of creating a safe access to the site, something that staff could administratively approve? Please note that grading on the adjacent property will be required. We will be working with the adjacent owner to obtain permission to do this.
